Couple take lumps since cookie suit

Durango - Herb Young turned the telephone off again Tuesday after it rang at 12:40 a.m.

One recent caller had told him that "you should be found dead in a ditch."

Nine out of 10 calls to his house are from "crackpots," he said, ever since a plate of cookies and a case in La Plata County Small Claims Court turned life upside down.

The grouchy people in our neighborhood would get twine tied to their house and during different times of the night it was rubbed.
This would set up a strange sound and one old lady thought her house was haunted.
I was a mean old man even in the fifties.

Maybe a campaign to mail cookies to this person would be appropriate. She could have piles of cookies delivered everyday via mail. No I guess that would be harassment so no.

I think this lady is getting a little bit of a bum rap-
She was terrified by someone delivering cookies at 10:30 (at night) who did not reply when she asked who it was.

So far that seems reasonable behavior.

She then became physically ill and incurred medical bills- this is a little far-fetched, maybe but she could be legit.

She admits the girls is usually nice and she did not think she meant to cause harm... but who pays her out of pocket expenses?

I dont think I would have SUED though (didnt the girls offer to settle first?) But to have people call and give death threats? thats stupid..

Except if you read on, it looks like there were two conditions: 1. seeing the bill (makes sense to me that they would want proof of the expense before paying it), and 2. the woman had to agree not to sue for additional money. The second condition also makes sense, otherwise paying could, I think, be seen as automatic admission of liability and, rather than resolving the issue, would open the door to more damages. Both of those conditions seem reasonable to me...

I understand your point, and I had a little initial sympathy for the woman. An unexpected knock at the door at night would make me anxious too.

But, after the girls families offered the 900 payment and the "victim" refused because she didn't want to sign a waiver against future action, she lost any sympathy I may have had regarding her anxiety.

You're right... that is too funny. Didn't Bill Clinton testify at one point that he was never "alone" with Monica Lewinsky b/c there were Secret Service agents in the other room or something? I think his approach was that he was never "alone" as long as there were other people in the building, or the ZIP code, or on the planet.... So it would seem that the definition of "alone" is perhaps not as clear as once was thought!

As for this writer, I think this is the kind of sloppiness that used to get caught, but now I guess we're so used to it that most of us just read right past it.

Even here in Tennessee, if you shot and killed some kid who knocked on your door at 10:30, ran without trying to break in, did not even try to vandalize your property, and left you a plate of home made cookies she'd made, you'd end up dong some serious time and being successfully sued for just about all you own. You darn better well your target and have a genuine fear of home invasion before you use lethal force. I'm a retired lawyer, have a CCW permit, live alone in the country, and keep a loaded pistol readily available.

Yes, a random act of kindness, albeit carried out in a fairly clumsy fashion, warrants their being shot and killed.

With attitudes such as yours, I have a pretty good idea of what you deserve for the rest of this life AND the next. God will not take advocating the murder of innocents terribly lightly. Don't bother taking a sweater, you'll not be needing it.

From what I have heard, with what those kids did, if they had tried that around here they would have been dead late at night isolated house, no car in the driveway, sick mother (two women by themselves).

Sure. Lethel force against a couple of kids with a plate of cookies RINGING the door bell. If that's your understanding of what self defense law is get rid of your guns for everybody's sake especially your own.
