Please help me on this fundraiser

I have been accused of something that I didn't do
And I am being sued for it!

On December 2, 2000, I held a rally in New Haven in front of then Vice Presidential candidate Joe Lieberman's house, doing what little I could to show support for the newly elected President Bush, and to show my frustration at the Democrats in their attempts to overturn the genuinely won election by George W. Bush.

At the end of the rally, Former Ct State Senator Tom Scott was speaking on the back of my truck, when all of a sudden the lead Democrat supporter of the counter rally held at the same location, started to approach my truck, then turned and took 3 or 4 running steps and jumped on the bed of my truck in a manner that I thought he was going to attack someone on the truck: either me or Tom.

I stepped to his side and held out my arm to stop him as he ran into my arm and immediately stopped his forward motion.

I kept my hand held out in front of him to prevent him from going forward on the truck bed and get closer to Tom who was speaking at the time.

After 3 seconds or so, the man who jumped on my truck immediately turned and jumped down off the truck into the arms of the Police who quickly escorted him away from my truck.

The whole incident lasted no more than 5 seconds it seems.

Tom and I decided to not press charges for assault or trespass on my truck, and let him go.

9 months later, the man filed suit against me for assault.

I am not joking.

9 months later.

He claims I grabbed his throat.

Look at the picture. This picture was taken December 2, 2000.

That is the man who claims I was grabbing his throat. My hand is on his chest, not his throat. My hand was NEVER on his throat, nor was it ever near his throat!


Why I made this website
Because of the lawsuit, I am forced to endure thousands of dollars of debt that I cannot afford. I have been employed only in temporary positions since 2001 when telecom collapsed, and am deep in debt.

This man is trying to use the legal system to get tens of thousands of dollars from me that does not belong to him, and he is doing it by claiming I assaulted him, which I did not do at all.


CAN YOU PLEASE HELP??
I am forced to ask, but can you consider donating to help me pay my legal fees?

Because of this false charge against me, I am now over $8000 in debt to my lawyer, and we cannot continue until I can pay my bill!

City teen, pastor involved in scuffle
New Haven Register
Sept. 16, 2003

NEW HAVEN — It was primary day in the city, and elections in New Haven are rarely uneventful.

However, last Tuesday, the primary drama took a new twist when a city teenager campaigning for the mayoral challenger alleged he was choked by a prominent city pastor and political powerbroker.

The Rev. Boise Kimber, one of Mayor John DeStefano Jr.’s staunchest supporters, denied choking 19-year-old Joseph Cotton, but admitted to police he pushed him because he felt "threatened." No charges were filed.

Cotton supported Sherri Killins, who opposed DeStefano in the Democratic primary, which DeStefano won handily.

The breach last Tuesday likely would have gone unnoticed were it not for the participants. However, because of Kimber’s prominence — and propensity for controversy — the story made its rounds through politicos across the city.

The incident happened just before noon outside Martin Luther King School, 580 Dixwell Ave., one of the city’s polling places.

According to a police report, Cotton ran up to a police officer and claimed he was hanging Killins political posters near the school when Kimber walked over and "grabbed him around the neck."

A moment later, Kimber approached the officer and initially maintained he didn’t touch Cotton but accused the young man of both pulling down DeStefano signs and stapling Killins signs on top of the mayor’s posters. During the same conversation, however, Kimber acknowledged he did push Cotton but did so because he felt threatened because Cotton was holding a staple gun.

Another witness at the scene came forward, who supported Cotton’s claim. The alleged witness, a 45-year-old man from Dixwell Avenue, said there were some words exchanged between Kimber and Cotton before the reverend grabbed Cotton around the neck.

The witness told police he couldn’t hear what was said but indicated he was shocked and surprised by Kimber’s conduct, according to the report.

Contacted Monday, Kimber declined comment about the incident. A message was left for Cotton, who had filed paperwork to run for the Board of Alderman before withdrawing as a candidate.

No one answered the phone number listed for the alleged witness. There was no answering machine.

In the beginning, Cotton said he wanted Kimber arrested, but later told police he didn’t want to pursue the matter.

Kimber, the pastor at the First Cavalry Baptist Church, has been a political lightning rod in the city for decades. Last year, he made headlines when he stepped down as the chairman of the Board of Fire Commissioners after making a comment some Italian-Americans on the fire department found offensive. Kimber said the remark, a reference to recruits with too many vowels in their names, was meant as a joke. After political fallout, he stepped down as chairman but remains on the board.

It is irrelevant whether your hand was on his chest or his throat, because you were defending against a trespass and an assault (as opposed to a battery), and therefore had every right to defend yourself and property with reasonable force. Even using Kimber's version of the facts, it shows that the force you used was eminently reasonable.

IMO, with an $8,000+ legal bill and a three year long case, your lawyer is taking you to the cleaners. This could have been easily resolved at the very first hearing with a motion to demur to the complaint. That's where your lawyer files a response that says Plaintiff's complaint failed to state a cause of action because the conduct alleged (the touching of Kimber) was perfectly lawful self-defense, and is therefore not actionable. And if Plaintiff seeks leave to amend his complaint, you point out that if he does, that you will be forced to file a counter-suit for assault, trespass and harassment.

But all the opinion and advice in the world, won't pay your bills, so Mrs. Boot Hill and I will be contributing to your legal defense fund.

This is seems to be a typical response from a Demrat and is outrageous.

Can you not counter-sue as well; pro-bono perhaps; for this man making false accusations and for character assasination?

Could you call, not just the ACLU; but Bob Barr at the ACLU? This Demrat was interfering with 'free speech' and he is guilty of intimidation AND trespassing!

That said. . along with many other Freepers; I would like to help with a donation; the Pay Pal page is not accessible - at least I am having a problem accessing (?) will conintue to try. ..but will send check if this does not work for me.

A controversial figure, Kimber still at center of political scene
Despite incidents in past, New Haven's political leaders seek his support

Staff Reporter On the Rev. Boise Kimber's wall hang photo collages of the minister schmoozing with Jesse Jackson, Al Sharpton and Bill Clinton. Nearby there is a large portrait of Martin Luther King Jr., the leader Kimber said he admires the most.

And right behind Kimber's desk is a matching portrait of Kimber.

"Dr. King has always been an idol of mine. And a lot of people looked at King as a troublemaker, but when King was assassinated he became an American hero," Kimber said. "I sometimes try to get my hair cut like him."

Although Kimber may cut his hair like King, he often cuts a very different public persona.

A close friend of Mayor John DeStefano Jr., Kimber helped deliver DeStefano an impressive victory in the close Democratic primary two weeks ago, and continues to be a vocal player in city affairs.

But Kimber, 42, is also a convicted felon known in some parts of the city for his aggressive campaign tactics.

Kimber's career began at age 15, when he started preaching in his hometown of Phoenix City, Ala. -- "sin city," as it was also known. He played football and preached his way through college. He arrived in New Haven in 1983 and emerged as a high-profile clergyman and powerbroker, someone the mayor calls "one of the strengths of New Haven." He founded Newhallville's First Calvary Baptist Church and is president of the Greater New Haven Clergy Association.

But along, the way, as even he points out, he found his way into a few controversies.

"Coming to this city I made a lot of mistakes," Kimber said. "I was a young guy, 23 years old, fresh mind, cocky. I felt I knew what I was doing."

He left his first church in New Haven, Pitts Chapel Unified Free Will Baptist Church, amid controversy, before founding First Calvary Baptist Church. In 1998, he resigned from his position at the Livable City Initiative, the city's anti-blight agency, after an investigation revealed there were no records of what work he was being paid for.

In 1996, Kimber was convicted of stealing nearly $4,000 in burial expenses from an elderly New Haven woman while he was managing a funeral home for the owner, who was in prison at the time. Kimber, who is black, was convicted by an all-white jury, and the mayor and police chief served as character witnesses at his trial. He was fined and ordered to pay restitution, as well as serve 2,500 hours of community service.

Despite his controversial exploits, Kimber remains respected by city leaders.

"President Clinton was kind of a controversial guy, I thought he was a pretty good president," DeStefano said. "There are few among us in public or private life who would do everything the same way we've done it."

For the political powers of the city, Kimber has been a helpful friend.

"He's very good at organizing people and putting together field operations, as a result of his ties to labor, his prominence in [the] religious community and his long-standing commitment to roots," said Julio Gonzalez '99, former Ward 1 alderman who is now running DeStefano's re-election campaign. "Some people really don't like him, some really like him, but I think he's tried to move away from being polarizing. I think in our campaign most recent he definitely wasn't as polarizing as he's made out to be."

Yet his tactics have also drawn controversy. In 1999, Kimber drew attention for verbally assaulting voters in an aldermanic race. More recently, he was involved in a yelling match with Jason Bartlett, campaign manager of DeStefano's primary opponent, fueling what was to become a summer of tense and often dirty politics.

Kimber, however, remains confident in his role.

"There were people who were negative against Dr. Martin Luther King Jr. against his stance on the Vietnam War," Kimber said. "There were people who were negative against Malcolm X, people who are negative against Jesse Jackson, the Rev. Al Sharpton.

"There's always been people who have shown negativism against black leaders, against those who have been in the spotlight and who have been vocal in their speech and in their conversation against the injustices of people. But it has not stopped my vocalness of bringing people together for a common cause."

But some community activists say Kimber's personality and boldness have done more harm than good.

"When you do something in the black community, it's hard as hell," said one community activist who asked not to be named because his work overlaps with Kimber's influence. "We have to work to get credibility. Then [Kimber] comes around and screws that up getting caught in a controversy with a funeral home. When we screw up in the black community it takes years to get that credibility back."

Other community leaders said they have trouble working in his shadow.

"When I came to this town there was a lot of skepticism about the clergy because of what Boise does," said another community leader who also did not want to be named. "He makes it tough to operate with integrity."

Yet Kimber does not plan on letting his detractors slow him down.

"I want to be a kingmaker," Kimber said. "I want to put the right people in office."
