He is a smart and well-spoken, and young enough (56) to serve for several years with distinction. I don't know if he alienated democrats as the chair of the RNC, but I suspect he could be confirmed.
My back-up selection would be Orrin Hatch, only because there is no way Arlen Specter would vote against him. But his age (70+?) limits his potential legacy.
In the meantime, I hope Rehnquist has a speedy recovery and lives a long and fruitful life.

Ann Coulter has a law degree, but has also had a very distinguished legal background. Honors, clerking, practise.
Believe it or not, she actually would rank as high legal talent and could earn millions as a lawyer, her background and career are quite exquisite.

But anyone who thinks that Bork or Coulter or Estrada or anyone else will get nominated doesn't realize how big of a problem we have with Arlen Specter. I know - I've already contacted Sen. Frist about him. Regardless, we can get someone we like only if we're very smart about it.

As a Montanaian who's voted for him, Marc is too Moderate. He would end up like another Sandra O Connell on social issues. Same with Hatch.

OK, you guys convinced me. The vetting's done and we'll scratch Racicot.
Racicot is too liberal on abortion and other issues. The "perfect" nominee is Michael Luttig of the 4th Circuit, and then Ted Olsen.
Are you stoned? Hatch is a disgrace needs to be drummed out of the Senate, and certainly not elevanted to spread his dementia to the judiciary. How quickly peopel forget his disgraceful "DREAM" Act and appeasement of The Swimmer.

I think Clarence Thomas should be nominated for chief justice when Rhenquist resigns.
Thomas is solid on the law, rejects being bound by prior court decisions when these decisions conflict with the actual words of the constitution, experienced, yet relatively young.
Liberals would further damage their African-American supporters if they try to trash him.
After that all nominees should be judges who will abide by the written constitution and the laws. Their previous records should be scrutinized to verify this.
Litmus test questions from liberals on how nominees perceive Roe v. Wade should be ruled out of order or met with the response "I will judge each case according to the constitution and the law."
There's a problem there - both the folks mentioned are politicians with little experience in higher law (at least to my knowledge).
That wouldn't be a problem if they were up for a Circuit Court seat or some lower court, but at the Supreme Court level, experience is at a premium, especially for the nomination and approval hearings.
Who, then? I haven't the slightest, but personally, I'd rather see someone with a few more years on the bench be nominated.

Why? Well, he would be better than Baucus, and was the only guy who could have beaten him, and he would have to answer to the people of Montana in 6 years -- he wouldn't have a lifetime appointment. Bedrock core principles are what matter in a job like that, or in an all-powerful job like the Presidency..
I trample all over chatter about Guiliani, Schwarzenegger, Pataki, etc... for President and Vice-President, too. But I would donate to any of them if they were campaigning to take a New York or California Senate seat -- they're the best we could get in those liberal hell-holes, and they deserve our help, our thanks, and our open arms. But only in jobs like those, or in harmless administration jobs...
There's a place for everyone in the GOP -- but conservatives need to decide where that place is...
