If that happens, i.e. 269-268, it still goes to the House because the winner needs a MAJORITY, not a PLURALITY. Had the same question myself last week, so I looked it up. Hope that helps!

If the Cali vote brings Skerry over the top in the popular vote, and the electoral vote is tied at 269, will the House STILL vote for Bush (even if he doesn't win the popular vote)??? I know they legally could, but would they???
