If this isn't motivation to get out and vote for Bush I don't know what is.

It makes for a vacancy on the court - same as if he resigns... one opening for a assoc. justice; and another opening amongst the 8 for Chief Justice. But Kerry will now be running amok (again) yelling about "a vote for Bush puts Scalia in charge of the Supreme Court."

If he were to pass, the Dems would demand no new Justice be nominated until after the election and swearing in. Then, whoever Bush put forth would be feasted upon by every liberal west if the Atlantic until a "proper" nominee was put forward.

* proper meaning liberal

Yeah, I almost added "Of course, that appointment assumes that the Dems in the Senate would actually permit it."

It is critically important that conservatives don't take their eye off the ball.

As serious a matter as the war on terrorism is, as important as you may find other issues, the battle for the courts trumps all.

With looming retirements and the Democrat filibusters, control of the upper levels of the judiciary is at a tipping point.

The result of this election will be felt for decades, if not for centuries.

The Left is losing power in the state legislatures, in the Federal legislature and rarely holds the White House. They're even now feeling pressure in the Academy and in the Press.

Their last refuge is with a radical judiciary. This is why their electoral strategy is to throw as much mud as possible and get close elections in front of sympathetic judges. The Left *must not* get control of the courts now.

This election is a challenge to "Broken Glass" Republicans and anyone who cares about what kind of country they leave to their grandchildren.

Don't let complacency, intimidation, laziness, the weather or anything stop you from going to the polls.

Contribute to conservative candidates (or the SwiftVets) as much as you can. Next summer's vacation is far less important than the future of the country. Put that money to work saving your nation. If our troops can risk their lives for the country we can at least cough up some cash and make a few "get out the vote" phone calls.

To quote John Adams in the musical "1776", "Now VOTE! Damn you, VOTE!"

09:12 PDT WASHINGTON (AP) -- William H. Rehnquist, second oldest man ever to be chief justice of the Supreme Court bench, has been hospitalized with thyroid cancer.

The 80-year-old Rehnquist spent the weekend in Bethesda Naval Hospital in suburban Maryland, and underwent a tracheotomy on Saturday, the Supreme Court said Monday in a statement.

The Supreme Court is not meeting this week, and Rehnquist is expected back on the bench when the court returns to work next Monday.

Rehnquist, named to the court in 1972 by President Richard Nixon and elevated to chief justice by President Ronald Reagan in 1986, has had a series of health problems.

In 2002 he missed several court sessions after hurting his knee in a fall at his home. He had surgery to repair a torn tendon. Rehnquist also has struggled with chronic back pain over the years.

Rehnquist turned 80 earlier this month, a milestone reached by only one other chief justice of the United States. The only older chief justice was Roger Taney, who presided over the high court in the mid-1800s until his death at 87.

I agree...Unless the GOP gets a super majority in the Senate because if the DIMs even get a slight majority and the Presidency (Heaven help us) the GOP does not have the spine to filibuster...
