I agree with you, but prosecutors tend to over-prepare because they hate to lose.
I still hear the little bird saying that the circumstances surrounding Berger's actions would make a great basis for going to a judge and getting a wiretap on his phone(s) to investigate what was really going on... Results of such an inquiry/investigation if made public at the right moment (Ashcroft's revenge for all the crap that has been thrown at him) could hit the media like a level 10 earthquake.
