It is one thing to keep secret the identity of someone blowing the whistle on government or corporate wrong doing. It is another to keep secret the identity of some one trying to commit fraud on the voters. If this got to the courts stations could lose some of their rights to keep sources secret. Who knows what the supreme court would rule when the source has forged documents in order to commit fraud. I can't imagine our supreme court leting CBS protect them from prosecution.
There has to be a heck of fight going on at CBS. They had best be able to prove the validity of whatever position they take next. They could lose the licenses to all their stations if they are not careful. It is the licensee who is liable. They did not fine Janet Jackson.. they fined the licensees. Rather is home free no matter what he did.. at least with the FCC. But CBS O&O stations could end up in line for license revocation or a forced fire sale.
I believe the right to keep sources secret was established in case law. That right could be severely limited. The Red Lion PA case of some years ago established the right of the FCC to revoke station licenses for playing political games.
IF CBS blows this it could cost the entire main stream media dearly.. and I do mean dearly.
CBS has to be having real conflicts. This is incredible. They announce noon, 3PM and then 5Pm. There has to have been major conflicts at CBS AFTER they think they had an agreement on how to proceed. They are making Richard Nixon's white house look like they knew what they were doing.
This is a lot more than a PR problem. This is serious and dangerous for all the media.

I guess youre familiar with these allegations that the bush National Guard records displayed on "60 Minutes were fake. Hey, as long as were cracking down on fake stuff on "60 Minutes, how about somebody looks into Mike Wallaces hair? The guy is 86, its jet black! How did that happen?
Actually new documents surfaced today proving that President Bush did not fulfill his National Guard service. CBS said they know theyre new because they were just printed over the weekend.
On the other side - this whole controversy has made the Bush people are pretty smug. Theyre saying this proves that even network news can get it wrong. Hey, we knew that when the networks said Bush won Florida.
Dick Cheney says that the economic numbers do not take into consideration all the people who make money on Ebay. Cheney said 400,000 people make money on Ebay. Well sure, after they lose their jobs, they have to sell their cars, and their jewelry.

NEW YORK, Sept. 15 (UPI) -- In the face of growing controversy, CBS anchor Dan Rather Wednesday stood by a story suggesting George W. Bush dodged his Texas National Guard commitment.Given that last paragraph and this being Dan's AM position, we can expect a full stonewall in the 6:30 news.The news story relied on a set of memos allegedly written by Bush's former guard commander that appeared to confirm long-held suspicions Bush failed to complete his service and benefited from special treatment.
A growing body of evidence, however, suggests the documents were forgeries.
Nevertheless, Rather -- in an interview appearing in Wednesday's New York Observer -- said the president still should answer the questions raised by the memos.
Those questions, the online paper said, "...have remained unanswered by the Bush administration: Did Mr. Bush get preferential treatment for the Texas Air National Guard? Was then-Lt. Bush suspended for failing to perform up to Texas and Air Guard standards? Did then-Lt. Bush refuse a direct order from his military superior to take a required examination?"
"It's never been fully, completely denied by the Bush-Cheney campaign or even the White House that he was suspended for meeting the standards of the Air Force or that he didn't show up for a physical," Rather said, suggesting the absence of such a denial suggests the story is true.
The focus on "questions over the veracity of the memos was a smoke screen perpetrated by right-wing allies of the Bush administration," he said. "This is your basic fogging machine, which is set up to cloud the issue, to obscure the truth."
