SAN FRANCISCO (Reuters) - Having sex with corpses is now officially illegal in California after Gov. Arnold Schwarzenegger signed a bill barring necrophilia, a spokeswoman said on Friday.
The new legislation marks the culmination of a two-year drive to outlaw necrophilia in the state and will help prosecutors who have been stymied by the lack of an official ban on the practice, according to experts.
"Nobody knows the full extent of the problem. ... But a handful of instances over the past decade is frequent enough to have a bill concerning it," said Tyler Ochoa, a professor at Santa Clara University School of Law who has studied California cases involving allegations of necrophilia.
"Prosecutors didn't have anything to charge these people with other than breaking and entering. But if they worked in a mortuary in the first place, prosecutors couldn't even charge them with that," Ochoa said.
The state's first attempt to outlaw necrophilia, in response to a case of a man charged with having sex with the corpse of a 4-year-old girl in Southern California, stalled last year in a legislative committee.
Lawmakers revived the bill this year after an unsuccessful prosecution of a man found in a San Francisco funeral home drunk and passed out on top of an elderly woman's corpse.
The new law makes sex with a corpse a felony punishable by up to eight years in prison.

Back about 20 years ago, my wife (who was just my girlfriend at the time) rented a house from some people who owned the mortuary next door. It was a family-owned business. One of the "boys" of the family (who was about 45-50 at the time) lived in the basement of the mortuary. He was REALLY creepy, and had never been married...Addams family sort of fellow....We always suspected him of being a necrophiliac.
Necrophiliacs were just "born that way" we shouldn't pick on them, it's hate speech!
Does that mean that "Theresa" and John can't go to California anymore?

Fwiw regarding morality, if the vast majority of Californians have rejected Judeo-Christian morals (what the ACLU or the media would like you to believe... and it could be more true than we want to hear), then why would they stand for a law like that at all?
In fact, once you drop those absolutes... standards of conduct, then Katie bar the door baby! IMO, one thing to point out to folks who think that homosexuality is totally ok, is that you can ask them why isn't necrophelia ok? (Or this 'phelia' or that phelia' because when you have no absolutes then nothing is really 'wrong' anymore).
When the morals are thrown out the window and if the "it feels good do it" way of life is ok because society says so, then who's to say what's wrong anymore about any kind of behavior. If who you are talking with gets repulsed with that argument then point out that given the progression (degradation) of Western civilization ... then by their way of thinking, Michael Jackson could be a trendsetter. Without absolutes... he could be leading edge (perish the thought!)
A complete disregard for God's ways degrades us humans quickly turn towards animalistic behavior (and even worse). Hence a law like this even needing to be written down is a sad testimony to where what our culture has become (as it ought to be obvious to any person with a shred of decency).
