Mom Sent To Jail For Smoking Around Kids

POSTED: 6:43 am EDT August 13, 2004

BOWLING GREEN, Va. -- A woman was sentenced Thursday to 10 days in jail for defying a court order not to smoke around her children.

Tamara Silvius was banned last year from smoking around the youths, now ages 8 and 10, as part of a custody arrangement with her ex-husband.

The article said she smoked in front of children on way to SC, since airplanes do not allow smoking, nor trains while in motion...it must have been a car, unless she had a two seater BROOM.

The article did NOT say she smoked in the car.

I can easily drive to SC and smoke in front of my child without ever smoking in the car.

SHEESH.

I said it earlier and I will say it again - there is far too little information provided in the articles for anyone to be making any judgements other than the fact the woman allegedly violated a court order.

The fact it involves cigarette smoking seems to bring out the Big Brother lovers, in otherwise rational conservatives.

Well if she wanted to smoke in bathroom of public place, or somewhere else on that trip, there would be no reason to fine her...noone would have known. That would have been logical thing to do.

Also, we don't know motivation by order, maybe one of children is allergic to smoke, I am. My husband is smoker and I don't see him smoke..he smokes outside, in his bathroom or somewhere else...but not in my car as I would choke even from the leftover smoke that stays in air.

This comes down to the fact that some pro-family politicians wanted to ENCOURAGE marriage so made it beneficial legally and from a taxation standpoint. It always comes back to bite you in the ass if you try to use governmental power to make a good thing more frequent. Let that be a lesson to those of you who think vouchers are a good thing. The line attached to those vouchers will be 'for use at schools that meet government accreditation standards,' and you can bet that will mean the gummint turns private schools that accept them into practically state schools, by the time they're done. Look what student loans have done to private colleges nationwide. The Citadel must take women.

Government in all its forms does no better than mess things up with YOUR money, taken from you at gunpoint.

As I said - it is all too vague.

The only possible way for the ex to know she had smoked in front of them was if one of the kids told him.

But smoking in front of them is very different from smoking in the car with them - which is what you claimed she did.

Smoking in front of them could very easily have been stepping out of the car and the kids being in the car and seeing her do so because she wasn't going to be were she couldn't see the children.

The info in the article is far too vague to make judgement either way.

I do not believe in anarchy and realize a certain amount of laws are needed, however, a line needs to be drawn.

violated the children's rights to clean air...who is she to take up all air space in a car!! THEN THIS MORON had to do it a second time, she is a real dilly!!

two things: 1, show me where ion the constitution exists a "right to clean air", then, once you've answered that... 2, show me where it says that it's government's role to provide the aforementioned clean air...

I have an appointment in the moring that will preclude me from being near a computer until sometime in the afternoon. I only state that to avoid any of the claims from the nannystaters that I am avoiding them!!!!

I get so sick of the self righteous attitude of controling people, I could puke. I have seen this type when I was growing up, as the oldest in a family of 5 with no father around, and a mother who had to waitress to support us. We had neighbors who were big on telling our mother how she should raise us and causing a bunch of fights with their troublemaking nosy ways. But I couldn't tell you the times I played with some of their kids and watched them eat popsicles, strawberries, canolope, all the treats we never could have because of finances.....and not offer one THING to us kids who were being so poorly taken care of. NOT ONE THING!!! Self-righteous hypocrites, that is exactly what these people are who are screaming about the health of these kids are.... because they do NOTHING...NOT ONE THING except tell everyone else how they should be doing it.

I don't need the government to guarantee me clean air, it is my responsibility as a parent to provide my children with good parenting, healthy lifestyle and clean air to breathe...and to teach them manners and respect, mostly by example.

The constitution does not address parenting skills, common sense should prevail. It appears you are out of balance with understanding parental responsibility and constitutional rights. And how you are dragging the constitution into it escapes me, doesn't even apply here.

In the article, the children stated in court that they had no problem with their mom smoking.

MYSELF I think the casinos here in RENO need to declare themselves smoking clubs, put up big signs to let EVERYONE know that there is smoking going on inside , and you could only work there if your a smoker ,lets start excluding the non smoking hounds ,and then then lets see their bitch.

Private business owners should be able to tailor their private businesses to serve whatever customer base they choose, without the threat of government force coming down on them.

That being said, I would also be free to avoid those businesses whos policies I disagree with. Being a non-white, I would probably not utilize the services of businesses that chose to discriminate - however, that is MY choice, just as it is THEIR choice.

Also, common sense would make most business persons aware that by alienating potential customers, they lose. In other words, market forces would create an environment where businesses would choose to serve anyone. No threat of government force would be, nor should be necessary. Those businesses that refuse to adapt would soon be out of business.

The same applies to the current topic - if a business chooses to allow smoking in their facilities, then if the market would not support that policy, they would either adapt and go smoke-free, or they would go out of business. However, we have not allowed the market to work like it should, and busybodies such as yourself have basically attempted to fix something that wasn't broken, and it didn't work. Businesses that were doing fine are now going under in large numbers.

I'm no liberal - I have no desire to control the lives of others through government programs, policies, or unnecessary laws - unlike you.

What? You mean to tell me that government isn't the solution to every problem, even problems that don't exist? Wow. We agree on something. Will wonders ever cease?

When you claim something to be a "right", then by necessity the constitution comes into play. That's why it was brought up. There is no "right to clean air". Never has been, and never will be until the liberals get their way and use an activist judge to say that their is...

He didn't say anything about one race or another being superior. He offered a rational opinion on government regulations. I'm sorry, but gratuitously throwing the racist label at someone in an argument is pretty much the defining characteristic of a liberal these days.
