Mom Sent To Jail For Smoking Around Kids

POSTED: 6:43 am EDT August 13, 2004

BOWLING GREEN, Va. -- A woman was sentenced Thursday to 10 days in jail for defying a court order not to smoke around her children.

Tamara Silvius was banned last year from smoking around the youths, now ages 8 and 10, as part of a custody arrangement with her ex-husband.

By the same token, shouldn't we also stand up for the vulnerable children who HAVE BEEN brought into this world? When that world is a smoky, cancer-causing cesspool, I applaud that man for having the balls to have the "no smoking around the kids" clause put into the divorce decree.

I assume then that you also support EPA laws regarding auto emissions and industry?

While you are so supportive of ALL laws, do you support the laws making abortion legal? Do you also support the courts decision in Mass. that legalizes homosexual marriage?

No, like everyone else in the world, FReepers are just as guilty of saying "hooray for the courts" when they make a decision that fitsd their agenda.

You're right. It's a tyranny issue.

Just like preventing murder and the pro-life community are tyrannical.

It's restricting one person's rights ONLY where they infringe upon another person's. Our laws do this all the time.

You can smoke in your house, fine. Preventing you from smoking in a restaurant is not a tyrannical issue at all, but a health issue for those who don't wish to smoke. Our county just went smoke-free in all restaurants and it is a great thing. NO more do I leave smelling like crap because morons want to light up in public. It's a great thing indeed.

I am about the most conservative person around and I am for pro-health, anti-smoking laws. Same as I am for other laws which prevent the rights of one person from infringing upon another.

But of course that's just plain common sense.

Good question, Miss Lion! "They" are probably worried about having 75 million angry smokers after "them", many of those millions also being gun owners. Also, "they" like "their" tax revenues from tobacco. But maybe "they" are just "stoopid". :^)

Not for those who don't wish to smoke, but for those who don't wish to smoke AND wish to be served according to their wants regardless of the desires of the restaurant owner. I think I'll try to get a law passed that all restaurants must have Mediterranian food on the menu. Hey, it won't give me heart disease like most of the other offerings.

First, it IS a court order and she defied the court order. Thus, do the crime, do the time. Second, smoking kills. She should quit, but I use to smoke and understand the attraction. In fact, sometimes even now if I see someone smoking it's all I can do not to walk up and suck the smoke right out of their lungs.

However, the judge should have looked at how this affects the mom's relationship with her children. The children would Probably have had to TELL the DAD in order for the court to arrest the mother. And the DAD definitely would have had to press charges. The DAD probably (and I'm a single mom, and this has happened to me and my friends numerous times) told the children to 'fink' on their mother if she smoked. Thus, the DAD is in the pilot's seat once controlling the mother and manipulating the children under the guise of "helping the children's health". Believe me, I've seen parents of both genders pull this sort of stuff.

I don't smoke, but if my children turned on me like that, they'd be living with their father.

And I'd be on the beach in Tahiti with Dex the Habana boy.

Before they passed the no-smoking on airline laws, Northwest voluntarily instituted a no smoking policy. I enjoyed patronizing them. The market will provide non-smoking eateries without resort to Government force. I just don't see that it's a diner's right to make a business owner provide him something he wants.

#1. Before the safety laws were passed, there were VERY FEW, if any non-smoking eateries.

#2. The diner is not forcing this issue. It's a matter of public health.

#3. This is SO CLEARLY a wise restriction preventing one persons rights from infringing upon anothers. Most all of our laws follow this same model.
