Source code stolen from U.S. software company in India

Jolly Technologies, a division of U.S. company Jolly Inc., reported yesterday that an insider at its research and development center in Mumbai stole portions of the source code and confidential design documents relating to one of its key products. As a result, the company has halted all development at the center.

Jolly Technologies is a vendor of labeling and card software for the printing industry. It set up its R&D facility in Mumbai less than three months ago, according to a statement from the parent company.

The company said that according to a report obtained from its branch in India, a recently hired software engineer used her Yahoo e-mail account, which now allows 100MB of free storage space, to upload and ship the copied files out of the research facility. The company detected the theft and is trying to prevent the employee from further distributing the source code and other confidential information.

The vast majority of U.S.-based software companies require their employees to sign an employment agreement that prohibits them from carrying the company's source code out of a development facility or transferring it in any way.

Though the Indian branch of Jolly Technologies requires employees to sign a similar employment agreement, the sluggish Indian legal system and the absence of intellectual property laws make it nearly impossible to enforce such agreements, the company said.

Representatives of San Carlos, Calif.-based Jolly Technologies in Mumbai are working closely with local law enforcement authorities, seeking their assistance in taking corrective action against the employee and to prevent such crimes from occurring again.

The company said it has decided to delay further recruitment and halt development activities in India until better legal safeguards are in place.

You're squirming about that? I have a cousin of mine who lost her purse, travel cheques, passport et al, from a 5 star hotel in Frankfurt. And what's more scary? The thieves were able to encash the cheques, even though by definition of such cheques, they shouldn't be able to do so.

Swiss dream turns sour for Indian couple

MUMBAI: The road less travelled may be a lot of fun, but not if you are robbed of all your money and left stranded in a foreign land.

On July 2, Dadar Parsi Colony residents Noshier Wadia (66) and his wife Mahrookh (57) were robbed of their passports and money while touring Switzerland.

Recounting the harrowing incident, Wadia, a retired bank employee said, "I was robbed of my credit cards, two passports, two train tickets costing Rs 24,000 each and foreign exchange worth Rs 2 lakh."

The retired couple had used up their life's savings and provident fund money to fulfil their dream. But the dream turned into a nightmare.

The couple had reached Switzerland via France along with two relatives. "We touched Paris on June 29 and stayed there for a couple of days. On July 2, we boarded a train from Gare-de-Lyon station in Paris to Bern. After getting offat Bern, we took a train to Interlaken. As we were loading our luggage into the train, someone robbed my pouch that contained our passports, foreign exchange, airline tickets and credit cards," he said.

Stranded in a foreign land without any money, the distressed couple immediately tried to register a complaint at the Bern police station. But with the policemen un-derstanding little English, their pleas failed to evoke any response.

Fortunately, the Indian Embassy office in Bern came to their rescue. The Wadias were allowed to call their son in Mumbai, and he arranged for their return tickets.

After returning home, Wadia wrote a complaint to the Consulate General of Switzerland in Mumbai on July 9,2004. But the response ended with an acknowledgement receipt.

When contacted, a senior official from the Consulate General of Switzerland said that they had forwarded the complaint to the officials concerned in Switzerland.

The only way you got the police to take action against an employee who stole co. material was to pay them to arrest and prosecute. We had to do that once in a similar case and finally did persecute and prosecute the perp. We did it as an example to other employees, but the justice system there would have cared less is we hadn't paid them to do the job.

But isn't this a libretarian dream? Pay only for the service you need at the time you need it.
