What basing on? Her claim sounds reasonable to me. The other children each get $145k AND they are being supported until whenever. This child would have been paid support had the father been alive, much as the wife's children would have been supported into adulthood. I say the child should receive $145k plus whatever the appropriate support amount might be.
IMHO
And I am sure Mz. Diaz did not come up with that type of a scenario on her own.
Just know that now that she is making this a bigger issue her MORAL LAWYER will get one third of any settlement.
She should have taken her 145 and SS check and been done with it. Frankly I have zero empathy for her and I feel sorry for the poor child who will learn these horrible truths some day.
I agree. As for another post's homewrecker comment, let's all remember it takes two to tango. If business was taken care of at home there is no roaming. No excuse though.
She is trying to get his LIFE INSURANCE. The child was not a beneficiary. I don't think she should get squat. His legal family had that insurance in case something happened to him.
$145K AND SS benefits should take care of that child.
She is gold digging and trying to 'get something out of this'
>I say the child should receive $145k plus whatever the appropriate support amount might be.
I'm not a lawyer (but I stayed in a Holiday Inn Express last night), so I don't know if there is any case law that takes a wife's estate, from her late husband, and hands it over to an illigetimate child.
How can the wife of a cheating spouse be forced to pay child support for his bastard?
