SACRAMENTORepublican U.S. Senate candidate Howard Kaloogian (website: www.HowardForSenate.com) announced today that his effort to Recall Bill Lockyer will proceed because of Lockyers clear hostility to defending the peoples will on the definition of marriage.
Kaloogian said today that he will serve Attorney General Bill Lockyer with a Notice of Intent to Recall on Monday.
Earlier this week, Kaloogian, who served as Chairman of the Recall Gray Davis Committee, announced he would work with Peoples Advocate leader Ted Costa to collect signatures on a Notice of Intent to Recall petition which began the recall process. Since then, the two have collected more than enough signatures to advance the recall process to the next level.
Californians deserve to have an attorney general who will fight to uphold their laws and respect the will of the people. Based on his history on this issue and his tepid response so far to the outrageous conduct of Mayor Newsom in San Francisco, the public should have little confidence that Lockyer will vigorously defend the laws in California on marriage, Kaloogian said.
Unfortunately, up till now, Bill Lockyer has demonstrated that he is unwilling to be a champion for the people of California and their wish to define marriage as the union only between a man and a woman.
Kaloogian noted that Lockyers filing with the California State Supreme Court did not contain any advocacy for the constitutionality of Californias law. In fact, Lockyer made no assertions as to the constitutionality of Proposition 22 in his filing with the court.
Instead, Lockyer asked the courts to decide one way or the other on the legality of gay marriages.
Contrast this action to that being taken by New Mexicos Attorney General, Democrat Patricia Madrid, who took action herself to stop localities from issuing gay marriage licenses. Madrid sent law enforcement officers in to stop the issuance of any more licenses.
By contrast, Bill Lockyer has shown clear reluctance to defend Californias family code laws which make the definition of marriage completely clear. A recall is not the goal of this effort; the goal is to get Lockyer to enforce the law. If holding his feet to the recall fire is the only way to get him to do his job, I am prepared to do it with overwhelming support of Californians said Kaloogian.
Kaloogian explained that the recall effort is the fault of Lockyer himself, who appears to be following his personal support for same sex marriages instead of following the law.
When he was in the State Senate, Bill Lockyer maneuvered to kill the legislation that defined marriage as the union only between a man and a woman. Thats why the voters were forced to write and pass Proposition 22. Now Bill Lockyer has made it clear that he is unwilling to defend the voters will. Until he does, we will keep him on notice that he will lose his job if he continues his dereliction of duty, said Kaloogian.
Kaloogian noted that the legal dancing of Lockyer is exactly the kind of gamesmanship used by recalled Governor Gray Davis, who allowed the voter-approved Proposition 187 to die quietly in the courts rather than the vigorous defense that proponents of the initiative and the people demanded.
We are not going to let Bill Lockyer defy the will of the voters with Prop 22 as Gray Davis did with Prop 187, Kaloogian concluded.

Sacramento -- A bill banning California from sanctioning same-sex marriages performed in other states was approved yesterday by a key Senate committee after Democrats fought down GOP efforts to strip out the measure's recognition of domestic partnerships.
Inclusion of the domestic partnership parts of the bill is a victory for Democrats. It guarantees a veto by Governor Pete Wilson -- just what Senate President Pro Tem Bill Lockyer, D-Hayward, had in mind when he helped include granting various rights to domestic partners in the measure.
``Those (domestic partner) amendments will surely kill the bill,'' said Assemblyman Pete Knight, R-Palmdale, the author of the legislation. ``The governor will veto a bill that requires registration of domestic partners.''

SACRAMENTO Proponents of Proposition 22, the Protection of Marriage Initiative, sued Attorney General Bill Lockyer today after his extraordinary action last week of renaming the initiatives ballot title.
"Bill Lockyer is playing politics with Californias initiative process to score points with his special interest allies," charged Robert Glazier, a spokesman for the Protection of Marriage Initiative campaign.
Last week, Lockyer changed the formal title of Proposition 22 to read, "Limit on Marriages," discarding the previous title written by the Attorney Generals office. Nearly 700,000 Californians signed petitions titled "Definition of Marriage" last year to place Proposition 22 on the March 2000 ballot.
"Lockyer is trying to placate opponents of Prop. 22 by putting a misleading political spin on the title and summary, which he hopes will help defeat the measure," said Glazier.
"By disregarding the title placed on the ballot by almost three quarters of a million voters, the Attorney General has violated the publics trust. In the interest of fairness, voters should have the right to cast their votes on the measure as it was qualified for the ballot."
Before becoming Attorney General, Lockyer was the leader of the state senate and an opponent of legislative measures that are virtually identical to Proposition 22.
"While President of the state senate, Lockyer steadfastly opposed protection of marriage legislation. This political maneuver shows that he is plainly unqualified to make a fair and impartial judgment on this issue," added Glazier.
The suit was filed today in Sacramento Superior Court. A hearing has been set in Sacramento Superior Court, Department 23 Wednesday, December 8th at 9:30 a.m.
My problem is that the law says "NO" to gay marriage, but certain individuals are ignoring that law.
If they ignore one law, does it not follow that they will/do choose to ignore others?
I have a problem that the law enforcement establishment is not taking action ....
...not that I agree with gay marriage, but I have a bigger problem with selective enforcement of laws.
If they want gay marriage, change the law... don't just ignore it!
Because it is still just a California problem for now. Quite frankly I think this is just the issue to cause Kerry to lose Calfornia and for Boxer to be defeated.
No doubt! If the DemoRats do another Prop 187 and intentionally screw the voters by going to the courts to overturn the will of the voters and then pretend 'hey, we tried' I will be SO PISSED!
