Appeals court ruling favors Terri Schiavo's parents

TAMPA, Fla. -- Gov. Jeb Bush and the parents of a severely brain-damaged woman won two appellate court victories Friday in their quest to keep her alive against her husband's wishes.
The 2nd District Court of Appeal ruled that Bush's attorneys will be allowed to question witnesses in the court battle over a law that gave the governor authority to reinsert Terri Schiavo's feeding tube after her husband had it removed in October.
The appeals court also ruled that Pinellas Circuit Court Judge W. Douglas Baird did not follow judicial rules when he denied her parents, Robert and Mary Schindler, the ability to intervene in the constitutional challenge to the law.
The appeals court ordered Baird to hold further proceedings on the issue.
Schiavo's husband, Michael, has been battling the Schindlers in court for years to remove Terri's feeding tube so she can die. He says she would not have wanted to be kept alive artificially.
The Schindlers doubt their 40-year-old daughter, who lives in a Clearwater nursing home, had any such end-of-life wishes and believe her condition could improve with therapy. Their daughter has been in a persistent vegetative state for more than 13 years after collapsing from a chemical imbalance.

Terri Schiavo was subjected to experimental implant surgery in 1993 without prior court approval and without recommendation of her attending physician. Additionally, she was transported across state lines for said surgery. Additionally, follow up care was never provided and no further maintenance services have ever been provided for the implanted electrodes.) What implant surgery?!! What electrodes?!!

Family of disabled woman files motion of contempt in response to husband?s withholding of medical information
Clearwater, FL February 24, 2004: Today, the parents of Terri Schindler-Schiavo filed a motion in the Sixth Judicial Circuit asking that the court hold Michael Schiavo in Contempt of Court for disobeying a 1996 court mandate that orders him to divulge changes in his wife?s medical condition to her parents.
During the beginning of the week of February 16, Ms. Schiavo had experienced a bout of vomiting. Upon learning of her condition, her parents asked nursing staff and Hospice staff working at Park Place Assisted Living Facility in Clearwater, Florida what had caused their daughter?s illness and what was being done to treat her. The Schindlers were told by the staff that they could not divulge any information by orders of Michael Schiavo.
Tuesday, attorney Patricia Anderson filed a motion seeking Contempt of Court charges against Michael Schiavo.
In 1996, a court order from the Sixth Judicial Circuit, directed Mr. Schiavo to disclose any changes in Terri?s medical condition to her family.
Additionally, a court order in September of 2003 directed Mr. Schiavo to give a discharge summary from Morton Plant Hospital to Terri?s parents. As of this writing, he has yet to comply with the order.

This is just my opinion - that Judge Greer is waiting for Judge Baird to rule re: Schiavo v. Jeb. Jeb wants to depose hubby and Jodi. And, with Judge Greer, whatever FELOS WANTS HEARD, it happens yesterday. Felos has unfettered access to Judge Greer, not so for the Schindlers.

#452 was a duplicate but today on wfla radio 970, Felos was on and admitted to Terri's vomiting and that her doctors were treating her for it. Strange that Felos wants to assure the public that Terri is not in harm's way?

I agree with your sentiments, of course, but laws, laws, laws! Laws are the worst and last way to get anything done, especially when the ones we have are flouted. Do any of these mean, overbearing, power-drunk lawyers and judges remember that we freed the slaves in the Civil War? Under the guardianship law that they abuse so horribly, Terri is more of a slave than any black slave under the lash of a Simon Legree in the Old South. I agree that there are too many laws now and they don't enforce the ones we have, but whether we try to get the legislature to pass a law favoring Terri or not, the legislature is busy everyday passing laws. We may as well get them to pass laws we like.

Hi, fv & phenn -- thanks for the pings and for posting what you're hearing on the local news. I'm glad to see the family is pushing getting things done that were supposed to have been done. Darn shame they have to do that, but that's the way it is, apparently. When should they get their answers?

Michael Schiavo accused of contempt of court.It wouldn't surprise me in the least that this either doesn't get a hearing, OR if it does, Michael has a great rebuttal, OR if he does get held in contempt, he would gladly do the time before he turned any info over to the Schindlers. He's an animal. I hope he's caged up soon!
