Would it not be super if the 9th (and it's spiritual cousin, the SCOTUS) could learn from the 11th via judicial osmosis!!
That said, Scalia's statements foreshadowing how busy the SCOTUS was going to get regarding the culture wars are coming true. For the 11th's statements here are in essence, "Hey SCOTUS!! Listen UP!! We at the 11th think you guys don't GET what the difference b/t a LEGISLATURE and a COURT are!! - So, here's our clinic for you ... take heed."
One small problem: Kennedy, O'Conner - they'll only be too happy to respond to this challenge to their holy opinion-making privileges. I predict that in less than 12 months, articles will be published describing how the SCOTUS 'slapped' the 11th so that these uppity, provincial, judges are put into their place. Maybe sooner, but it's justice a matter of time.
But, like so much, I hope I'm dead wrong about this last comment.

"Paragraph I. Recognition of marriage. (a) This state shall recognize as marriage only the union of man and woman. Marriages between persons of the same sex are prohibited in this state.
(b) No union between persons of the same sex shall be recognized by this state as entitled to the benefits of marriage...

Its too bad the SCOTUS was not that wise when it had the Roe v. Wade decision before it. The supreme court turned itself into a political arm of the government when it decided to legislate in Roe v. Wade. It gave the green light to lower courts to do the same. Now judicial nominees are scritinized for the political beliefs and not merely on their qualifications as judges. The judiciary has turned itself into a circus. Hopefully this is a step back to sanity.
