While noting that 1 percent to 3 percent of the population could be considered retarded, the high court left it to states to determine which of the 3,504 death row inmates in America fall into that category. Since the Constitution is quite clear about the issues the Federal Government is authorized to address, this is a refreshing change from the usual way things work out. It should be state or local determination.

When will murderers be treated as murderers?
In this case the so-called "retarded" inmate is a MURDERER. Does a person's intellectual level proove that they are not a danger to society?
Of course, I feel the same way about "kids" who are not charged as adults when they commit very adult crimes such as murder.

I don't like affirmative action for retarded and mentally ill murderers. I could care less if said killer "didn't understand" what he was doing. They should be executed same as others.
I grieve for the dead and their families. Killers don't get my sympathy. Execute them so they can be recycled into a better existence.

On the night of August 16, 1996, Daryl Atkins and William Jones went to a convenience store to buy beer. Atkins was, at that time, in possession of a firearm that was concealed behind his belt.
He asked several people around the store for money. Eric Nesbitt, a 21-year-old airman stationed at Langley Air Force Base, entered the store and had a short conversation with Atkins.
Upon exiting the store, Atkins and Jones forced themselves into Nesbitt's truck. Atkins instructed Nesbitt to give him money from his wallet and then forced him to withdraw money from an automatic teller machine.
Atkins and Jones took Nesbitt to a deserted field in Yorktown and ordered him out of the vehicle and, after he had taken only a few steps, shot him eight times in the thorax, chest, abdomen, arms and legs.
The ATM camera caught Nesbitt withdrawing money from the ATM, with one of the two goons poking a gun into his side. A look af terror was evident on Nesbitt's face.
