Someone please help me here. My stepdad insists that no doctor would prescribe enough drugs that someone could get addicted to them. So, he's sure that Rush got them illegally.

I had a tax client who took the drug expenses as an itemized deduction. This client used multiple dentists and doctors with the same complaints. The only problem was he couldn't claim it on insurance otherwise the adjuster would notice. Likewise, he needed to go to multiple drug stores.

The interesting thing is that I am fairly convinced all the parties new he was abusing but continued to participate under the guise of plausible deniability.

"Not to put too fine a point on it, but if he DID have a legitimate reason for taking the drugs, why was he buying them on the blackmarket?"

I don't think that has been established yet.

With four doctors in the picture he may have been getting all the prescriptions he needed.
That is we now know about four doctors. There may be others.

I thought medical records were supposed to be private, like our Internet usage.

LOL

Yes, but the reason for suspicion against Rush in the first place was that the Feds got a memo detailing 20-30 'suspicious withdrawals' of $9,990 from a NY bank.

So Rush is under suspicion and they are getting his meidcal records when he has done nothing wrong that any other citizen might do.

President Bush is involved in this, too! I knew it! :)

I wish we get editing next.

He was going to four doctors so he could get four perscriptions at a time.

It isn't necessarily that way. I would expect that Rush would have ear drs, back drs, perhaps drs who specialize in autoimmune disease, a regular GP or whatever. They may all have been prescribing pain killers. But it doesn't HAVE to be the case that he was dr shopping specifically to obtain meds another dr wouldn't prescribe.

...what has happened to the fonts....they are shrinking.

Unknown. But to combat it you can hold down the Ctrl key and move the scroll wheel on your mouse one click at a time and view the resulting font size change and pick one that you like.

If you don't have a scroll wheel mouse and you are using Internet Explorer go to View>Text size and then choose a different font size.

Is there admissible evidence about the "blackmarket"? No.
Just the maid and a cigar box.

Florida's Evidence rules regarding priviledge and exceptions to Heresay.

http://www.flsenate.gov/statutes/index.cfm?App_mode=Display_Statute&URL=Ch0090/titl0090.htm

This could be a fishing effort for impeachment information. Or looking for inconsistencies.

Either way they are expending an UNUSUAL amount of effort on this one case. IN NO OTHER CASE would the Palm Beach State Attorney's office be expending this much time (courts are facing budget cuts) and effort ($$$) on a single user case.

In the normal course of business, they would have dumped this case in drug court in March of 2003 and forgotten about it. They had no evidence then, now they must have DNC pressure attacking them.

Has one been convened?

In most counties there is an ongoing grand jury. Some serve for three months at a time and meet on specified days.....

I eagerly await the anti-Rush crowd claiming special treatment. I have been involved as a defense attorney in dozens of similar, if not identical In fact patterns), cases and I have NEVER seen a prosecution of the addicted individual.

Really? How about Morton Downey, Jr. and Darryl Strawberry, just to name two. While I agree that it doesn't happen often, it does happen, and I'm sure Rush's comments about the idiots in Palm Beach County during the last presidential may be influencing prosecutorial discretion.

private medical records are not public records.

Right -- that's exactly the point: there seems to be no Constitutional or legal provision for grabbing records without either an announced investigation or a criminal charge being involved. He will own Palm Beach County.

"My stepdad insists that no doctor would prescribe enough drugs that someone could get addicted to them."

That is not true. Someone who thinks they can't live without the Rx is addicted to them.

Also it appears there was four doctors who he has been treated by. Each one of them could be prescribing without the knowledge of the other.

They can seize records like that under The Patriot act? Money Laundering is covered under its powers? Just asking-don't know.
