I thought medical records were supposed to be private, like our Internet usage.
To: longtermmemmory
PI wonder how long until they are published somewhere?

Limbaugh jsut announced on his show that the Palm Beach prosecutor seized his medical records from four doctors.
This is VERY UNUSUAL in a prescription drug user case. IT IS ALMOST UNHEARD OF with regards to prosecution cases.
Legally the Palm Beach Prosecutor's office is on a fishing expedition.

I just listened to his explanation. I eagerly await the anti-Rush crowd claiming special treatment. I have been involved as a defense attorney in dozens of similar, if not identical In fact patterns), cases and I have NEVER seen a prosecution of the addicted individual.
He is right that, were it not for his celebrity stature, this would never have gone this far and witch hunt is an appropriate term.

This is so dumb, they are going after Rush for withdrawing $9,900 from a bank?

It becomes a question of admissibility. The validity and cronic nature of Rush's pain would be an issue.
Usually it is the DEFENSE that introduces the medical records. This is really really unusual and smells extra fishy.

Is that seizure the kind of thing one might expect for a Grand Jury investigation? Has one been convened? On what other basis could this possibly be done?

In FL the only absolutly private conversation is attorney/client.
People should keep in mind this dates back to March of 2003. Drug user cases which occured in March 2003 should have an arrest and prosecution start in March 2003.

Given that Palm Beach County was ground zero for the Gore 2000 election challenge, and given that Limbaugh was a vocal critic of Democrat activities there, there could be some type of payback going on.

From the pulled thread:
Medical records released will show Rush had legitimate reasons for taking the drugs
Not to put too fine a point on it, but if he DID have a legitimate reason for taking the drugs, why was he buying them on the blackmarket?
It seems that his own doctors would have given him the prescriptions if he needed them.

Perhaps the doctors are the actual target of the investigation.
