The difference is: When the Dems get back in control and a Dem Pres tries to get a liberal judge, and the Pubs try a filibuster after the judge's name is out of the Judiciary, the Dems will force the Pubs into a 24-7 filibuster, not one of these pansy 2-hours-then-a-couple-of-week's-rest filibuters Frist has allowed.

There is a 24-7 filibuster going on now, and has been going on for some time. The nominees are not being allowed a vote. The Democrats have decided to filibuster, not the Republicans. I'm not sure what your point is.
