I heard "stable," which really doesn't mean anything (it's good, fair, serious, critical--I'm sure I'm missing one or more). At least the shooter didn't hit any vital organs. The guy is really lucky--and the shooter will definitely be charged with attempted murder.
The real hero is the off-duty reserve deputy who made the flying tackle. The Court TV cameraman who was pointing to him in the video said in one his interviews he thought the guy would start shooting randomly at people in the area.
Two points -
1. Adequate range time and familiarity with a firearm are essential to speed and accuracy while shooting. It is apparent that this particular assailant had not bothered to take the time necessary to successful performance.
2. Any successful hunter knows that game has to be flushed out from any cover, whether it is fowl or mammalian, as cover not only allows the prey an opportunity to obscure movement, it can actully deflect shots.
