It seems in your post 2115 of the law of Florida when there is no living will, the patient picks the health surrogate with regards to making decisions about life pro-longing procedures

Terri's parents signed guardianship over to Schiavo on the Good Faith that he would take care of her, as he told the court he would when he was trying to cash in on the malpractice suit, he said he would take care of Terri and provide rehablilitation wich he has not done.

This case is not that hard to figure out. I'm wondering; as are others, if Terri's parents really have the best legal counsel, or if everyone is working as hard as they claim to be-not trying to be cold/mean, but it is pretty obvious what Mike SCH is up to.

Or the problem could be corruption on a massive scale. In wich case people need to be brought in who have the expertise/resources to deal with it.

It's just strange that Felo's has managed to beat them every time , in spite of some very convincing evidence..I don't know , just thinking out loud -so to speak.

I agree with you about the Schindler's attorney. I know nothing about her. She seems to be dedicated, but from seeing her on a couple of interviews, including Greta just last night, it seems that a more outspoken attorney is needed. She only made one comment, about Felos' "death process" comment. She made it in a snide referral to Felos' spin of his attempts to kill Terri. However, it didn't come across as sarcastic. Her tone almost made it sound as if that is what she calls it. Maybe she's just tired, which is entirely understandable. Whatever the reason, some extra, firm legal help is needed.

As for the law, I would pursue a couple of things. I would pursue Mikey's availability and competence of being Terri's surrogate due to his adulterous relationship, especially considering this is a crime under Florida law.

Since that would hinge on a DA and judge's discretion, I would then pursue the Constitutionality of the laws regarding guardianship with the lack of a living will. The law as written is contradictory to the section that states that nothing in the chapter on living wills should be considered to authorize euthanasia. This coincides with the Constitution. Allowing food and water to be considered life-support and allowing one to kill another with no clear evidence of the person wanting that could be used as the basis for the Constitutional argument.

It seems to me that Michael became the guardian under FALSE PRETENSES, by testifying UNDER OATH that he would take care of Terri for the rest of his life, and convincing the Schindlers of this, thus prompting them to act in good faith and let him assume guardianship.

This is so WRONG. In my opinion, there should be a way to remedy this for the Schindlers to resume guardianship.
After all, they HAD guardianship at one time, and only relinquished it because Michael led them to believe he would take care of her, not cause her to be starved to death!

His guardianship should be null and void, in my opinion.
