Terri's brother, Bobby, just reported that Terri is MISSING!! He has been waiting all day to see her, he got the green light, and she's gone...

News 9 reporter said she's gone back to hospice, but the family does not know where she is and has NO CONFIRMATION.

I've not read through your post yet, dixiegrrl, but Felos announced today that Terri was approved for Medicaid .. would that be State or Federal? Seems to me if it's Federal, she comes under the protection of FEDERAL law - who are our FReeper attorneys? The appeals were sent back from Federal to State because it was a STATE matter.

I'm wondering if---assuming (as we don't) that Terri DID make some statement to MS about right to die---it should be considered a remark made by a person suffering depression (as over the demise of her grandmother), and therefore a remark of less weight.

Well, according to the one affadavit, the nursing staff were threatened with loss of their jobs if they challenged. For a nurse, that would be a bad thing to have on your record.

but there just needs to be a net like this where this a disagreement bteween the spouse and the parents (like an assigned guardian and governor's stay)

that's what I mean - a law (a net) to prevent a situation like this where there are such opposing sides and the loved one is not able to speak for themselves. I think it's horrible that he prevents the family from seeing her too - the state should step in and allow for visits by her parents and siblings too - the marriage license this guy bought shouldn't let him "own" her life - esp since he want to kill her.

Still wondering, does anyone know how long they were married before she became injured?

I would say draw up a letter and include excerpts from his book and offer your thoughts. Of course, you would have to word it carefully enough that YOU not sound like the whackjob. Send it to all the regulars on the major cable news and talk radio programs.

PINELLAS PARK, Florida (CNN) -- The father who has fought for more than five years to keep his brain-damaged daughter alive said when he visited her Thursday, she turned down his kisses, saying, "Uh-uh."

"I was in front of her and I'm kissing her on the cheek, and she doesn't like that," said a smiling Bob Schindler after visiting his 39-year-old daughter Terri Schiavo.

He said he then asked, "'Do you want me to kiss you again?' She goes, 'Uh-uh. Uh-uh.' That's what I got from her."

Terri Schiavo's brain was damaged in 1990 when she collapsed from heart failure, the result of doctors' misdiagnosis. She recovered from the heart attack, but oxygen was cut off to her brain, leaving her in what doctors call a "persistent vegetative state."

Eight years later, her husband and legal guardian, Michael Schiavo, filed a court petition to remove his wife's feeding tube as he claims his wife wanted, according to the St. Petersburg Times. The woman did not have a will.

Terri Schiavo's family fought the move, maintaining that their daughter responds to them and should be kept alive with a feeding tube.

Schindler said Wednesday his daughter is "alert, active, a live human being" and said videotapes that showed her condition moved Florida Gov. Jeb Bush to act on her behalf.

Michael Schiavo claims Terri did not want to be kept alive artificially. Doctors said last week she would have died within two weeks without the feeding tube.

A court seemingly ended the five-year legal battle when it ordered the tube removed last week. But the state legislature quickly passed a law giving the governor the right to intervene, which he did Tuesday. The feeding tube was reinserted Wednesday.

Michael Schiavo's attorney, George Felos, said the law allowing Bush to order her feeding tube reinserted is unconstitutional. His attorneys asked a circuit court judge in Pinellas County Tuesday to grant an emergency injunction preventing the re-feeding of his wife.

The judge rejected the request, but gave attorneys five days to file paperwork for a permanent injunction.

"Each of us -- and the Florida Supreme Court has said this -- has a right to control our own body," Felos said. "We have a fundamental right to make our own medical treatment choices, and the state doesn't have a right to override our wishes."

Michael Schiavo has not allowed the family to see Terri Schiavo's medical reports, but Wednesday he allowed them to visit her.

Schindler said when he saw his daughter Wednesday night she looked withdrawn, but "today it's just the opposite."

He said his daughter looked a little weak from not having food for a week, but "other than that, she really looks good, I mean, too good.

"She looks like she did before this incident with the tube," he said, adding that the family is trying to get access to medical reports on her current condition.

Asked if the husband may finally give in to the family's demands and just walk away from the entire case, Schindler said he was unaware of any such possibility, but would definitely welcome it.

"Michael Schiavo is not our primary concern," the father said. "It's to see her back to the condition she should be in."

Independent guardian to be appointed

A Pinellas County Circuit Court judge this week ordered lawyers for both sides to agree within five days on an independent guardian for Terri, as required under the law signed by the governor.

The new guardian would become Terri Schiavo's advocate in legal proceedings, but Michael Schiavo would remain the decision-maker.

If an agreement cannot be reached, the judge said he will appoint Dr. Jay Wolfson, a professor of health and law at Stetson University, as the guardian. Wolfson also works for the College of Public Health at Florida State University and the College of Medicine at the University of South Florida.

Terri Schiavo's parents have accused their son-in-law of selfish motivations. Michael Schiavo -- who has a girlfriend with whom he has a child -- won $1.2 million in a malpractice case against his wife's gynecologist and another $250,000 in a settlement with her general practitioner. Most of that money was to go toward her treatment.

In addition, he received $300,000 for pain and suffering and loss of consortium.

Michael Schiavo has declined to comment on whether there is an outstanding life insurance policy on his wife.

I guess it is federal. I found this when I typed in medicaid on yahoo. The Centers for Medicare & Medicaid Services (CMS) is a Federal agency within the U.S. Department of Health and Human Services. Have we focused only on Florida, the media and the feds with our email/fax/phone call campaign? Have we hit our own representatives, governors and senators with this? Perhaps this would be a good thing. I mean, it isn't like Florida is the only place that is the only state where this could happen. Perhaps if we could stir some interest at state level as concerned citizens for what could happen in our own states, then they might take steps to bring some pressure to bear on what happens in Florida. We could maybe use this opportunity to put the courts in our own states on notice as well.

I sent this e-mail. They may trash it but I figured the seniors are usually very caring and that if they knew they might be at a risk too them maybe AARP could flex some muscle for Terri.

I need to ask if you will look into the Terri Schiavo case in Florida. I realize she is not old enough to be a member of this organization yet but her parents are and there are a lot of members that do live in Florida and other states, who will unfortunately reside in nursing homes as they become disabled and age. Terri and her family need help. She, the disabled, and the elderly have a right to life. Your assistance is appreciated

I wish someone would explain to me why Terri can be starved to death when assisted suicide is not legal.
MS is predicating his actions on a claim that this is Terri's choice. That makes it a suicide they're assisting, no?

BAY NEWS 9 ATTY FELOS HOLDING PRESS CONFERENCE NOW. Oops. Attorney Felos said "Mr. Schiavo as Terri's spouse wants to make sure that he follows his wishes." I mean "her wishes."

Hubby is going to fight Terri's Law as unconstitutional. There is 65K left. Terri's treating doctor at present is: Dr. Stanton Trikotas (Greek). Terri is in Medicaid because a home is a marital asset allowed.

72% in AOL disagreed with Gov. Bush in a poll. Felos says Americans agree with husband. Gov. putting best spin on this. Attorney Chamberlain approved Terri's Medicaid Application and she qualified. Someone asked him about MS' big car and fancy house. Felos said "not affluent lifestyle."

Felos has limited resources and is running out of time. Mad that Governor Bush took Terri out of her death bed and he's been getting positive, supportive emails that support what Felos is doing. Michael feels so glad that the public is on his side.

They want to get Terri's law declared unconstitutional so they can get back TO THE DEATH PROCESS. After Terri is dead, they will look at all of the events to decide who Felos will sue (ie doctors for malpractice). No comment re: video of Terri acting very much alive. Admitted that Terri looks good today, color good. Said her cerebral cortex is gone. She can't think.

Finally, Felos just stated on Bay News 9 that the reason the family hasn't gotten any medical information is because they didn't ask for it and finally, he said the chance that both sides would agree on a guardian are "remote".

He said that he sposes the Court appointed guardian might be okay, is a lawyer and has medical background.

Pretty d****d flimsy argument if you ask me. He has a sudden recollection of her "wishes" fully 8 years after the incident and gets one of his family members to corroborate his story. Would it hold up if this were a murder trial. NO! It would be hearsay. But I guess it would be different because then we would be protecting a criminal's right to life. The innocent are given much stiffer penalties on a lot less.
