Cruz Birther Suit Judge Not Sure She Has Jurisdiction

An Illinois judge on Friday said she would decide next month whether she had jurisdiction over a voter's complaint that Republican presidential candidate Ted Cruz should not be on the state's primary ballot because he was born in Canada. Lawrence Joyce, a lawyer and pharmacist, filed a complaint in January with the Illinois State Board of Elections saying that under the U.S. Constitution, the Texas senator cannot run for president since he is not a "natural born" citizen. Cruz was born in Calgary, Alberta of a Cuban father and an American mother.

The Board rejected Joyce's complaint - saying Cruz became a natural-born citizen at the moment of his birth because of his mother's citizenship - so he petitioned the Cook County Circuit Court to review that decision.

Circuit Court Judge Maureen Ward Kirby said she was not sure she had jurisdiction, and set a March 1 hearing for arguments on whether to dismiss the complaint.

The complaint comes in the wake of repeated attacks on Cruz about his eligibility by New York businessman and presidential rival Donald Trump....

Absent more or better info, How the state of Illinois chooses and instructs its state electors to the electoral college appears to have been intended to be primarily at least a state issue, from what we know so far anyway — if somebody has better information they’ll almost certainly share it with us here . (I assume but do not know if this case is filed in the correct court in Illinois... If it’s not, the court will certainly so advise ... We will see what happens ...) and I remain very open to learning more or better about this. Jurisdictional questions can be very, well, arcane... Even weird, actually. But a state’s electors to the electoral college were at least set up to represent that state and be subject to that state’s jurisdiction primarily.

People do NOT vote for the president. They vote instead for STATE ELECTORS to the Electoral College

Well, all 50 states have chosen to adopt voting as the method of appointment of Electors, but it's not required. Any Legislature that so chooses can appoint Electors directly, by coin toss, by a rugby match between Democrats and Republicans, or by reading the entrails of an owl.

The extra 7 states are, Baja Arizona, the State of Jefferson, North Colorado, North Florida, South Florida, the State of Lincoln and West Kansas. ;-)

The Constitution is a funny thing, the public can interpret its meaning however harshly it chooses.

A questionable meaning doesn’t necessarily have to go to court to get “resolved.” The court does not step into the voting booth and select a candidate, We the People do. The court can choose to do nothing or come down on an issue like a ton of bricks. WE can still choose to ignore their ruling.

Abortion is a good example where the court has ruled in favor on a woman’s right to choose to end a pregnancy before birth. Many people disagree with this ruling and view the act as federally sanctioned murder. Every voting cycle this issue is used as criteria for and against any candidate who has taken a side on this subject.

Ted doesn’t have to answer to the courts on this issue of his eligibility. This issue came up long before Trump entered the race.
