A Democratic-proposed gun ban would prohibit some of the most highly-rated hunting rifles and shotguns, ban most pistols, and require Wisconsin residents who owned so-called âsemiautomatic assault weaponsâ to turn their guns in to the government. State Rep. Lisa Subeck and three other Democratic state lawmakers are proposing a sweeping ban on rifles, shotguns and pistols they deem dangerous because they are âdesigned to kill large numbers of people quickly.â
Legislative attorneys â known as Legislative Counsel â confirmed to state Rep. Dave Craig (R) that the loosely written ban does not contain a grandfather clause, meaning owners of prohibited weapons would need to turn them in or face felony charges for possessing an illegal weapon. âContinued possession of a firearm defined as an assault weapon would generally be illegal under the bill draft beginning the day after the date of publication of the enacted bill,â legislative attorney Larry A. Konopacki explained.
But Konopacki wasnât the first to spot the troublesome lack of a grandfather clause. State Rep. Adam Jarchow (R), an attorney, also noticed that there was no exception for those who currently own a weapon that the legislation seeks to ban. Jarchow told Media Trackers on Thursday morning that, âon first reading there appears to be no grandfather clause.â
Thatâs a big problem for gun owners in Wisconsin because the way the draft legislation defines âsemiautomatic assault rifleâ (a term thatâs somewhat redundant), dozens of different gun types would be banned. State Rep. Cody Horlacher (R), also an attorney, reviewed the proposal and told Media Trackers the definition of a banned rifle âis so broad, anything could fall intoâ it.
Research by state Rep. Dave Craig (R) found that the proposal would outlaw three of the top five rifles recommended by the hunting resource website Realtree.com for shooting hogs. That matters because the Wisconsin DNR has declared feral hogs to be âexotic, non-native wild animals that pose significant threats to both the environment and to agricultural operations.â The DNR has asked hunters to aggressively hunt the hogs to protect the environment.
âIt is unfortunate that my Democratic colleagues, in their haste to trample Wisconsinitesâ 2nd Amendment rights by making law abiding Wisconsinites felons simply for keeping their current firearms, also failed to realize the negative environmental and agricultural consequences of their dangerous proposal,â Craig said of the legislation.
When it comes to shotguns, the proposed ban would make it illegal for a Wisconsin hunter to own some of the most highly rated Turkey hunting shotguns. In fact, four of Game & Fish Magazineâs top ten shotguns for Turkey hunting would be specifically banned.
Most semiautomatic pistols also appear to be off-limits if the proposal ever becomes law â a nearly impossible prospect at this point with the legislature controlled by Republicans. A loosely worded prohibition on pistols with, âa shroud that is attached to, or partially or completely encircles, the barrel, and that permits the user to hold the firearm with the nontrigger hand without being burnedâ would make iconic handguns like the 1911, or popular pistols like the entire Glock product line, illegal. Perhaps the only semiautomatic pistol that would be legal would be the Luger, a German World War II relic.
âEven though a semiautomatic pistol slide is not designed for the purpose of being held by the nontrigger hand, particularly while the firearm is being fired, it could be argued that a slide still meets the criteria for inclusion under this provision,â Konopacki wrote in his letter to Rep. Craig. âArguments could be made both ways here, and it is impossible to predict with certainty how a court construing this phrase would do so.â
Rep. Horlacher shared that assessment.
Because a majority of the semiautomatic pistols sold today could fall under the ban, Wisconsin pistol owners would likely be required to turn over tens of thousands of handguns to the state under this provision.
While the proposal is dead on arrival in this Republican legislature, it does reveal what some of the leading lawmakers in the Democratic caucus would do if their party had a legislative majority.
When it’s time to bury your weapons, it’s time to dig them up . . . and use them.
I hope every decent person in Wisconsin will buy all the weapons they need and all the ammo they can afford. As a former Boy Scout, from the days when Scouting included “morally straight”, all I can say is: “Be Prepared!”
The gun confiscation comes just before the leftists get down to their real goals.
The lack of a ‘grandfather’ clause, while bad, isn’t the primary concern with this matter. The legislation itself is terrible!
These people need to rise up and fight for their second amendment privileges. /s
These arrogant 'rats just don't learn.
Gov. McAuliffe (D-VA) saw his anti-gun agenda trounced in the most recent election.
Keep it up you 'rattards, if the 2014 election results portend what will happen in 2016, you're outta here.
The time to buy the weapons and mags was 20 or so years ago, but better late than never, I guess.
They can’t find and deport eleven million illegals, how are they going to find over three hundred million firearms?
The Democrat Party does us a favor when they propose legislation that clear demonstrates who the Nazis they are. This especially applies in Wisconsin where the Nazi Democrats have abused the rights of law abiding citizens on a number of fronts. Fortunately, they are out of power at the moment, but they fully expect to regain their position and then they will exact retribution. People who think that there is no difference between Democrats and Republicans need to reconsider.
They can have mine....when its jammed or I’m out of ammo. However they better be prepared to DUCK you mutha!
“They canât find and deport eleven million illegals, how are they going to find over three hundred million firearms?”
They’ll hear ‘em...one or two at a time.
Try it, libs, we’ve had it with you.
When the tipping point comes......you’ll not be happy campers.
There is no avoiding it. Like oil and water, there are two polar opposite world views that are in competition and there is no accommodation. The end is a civil war that will be much less civil than the previous.
I keep hearing and witnessing the prevailing winds blowing towards a candidate that will save us and make all things right. Folks, there isn't a candidate alive that is going to prevent what is coming. The sides are too entrenched.
The only question is what to do now after realizing where this road leads.
We need to go to work on a constitutional provision to ban Democrats.
I will be starting a signature campaign to get the issue put on the next presidential election ballot.
If I’m still upright after that, then I’ve still got my SOG hawk and a couple of Cold Steel tantos waiting.
Death to the Left.
Every time the Democrats heavily promote gun control bills, they lose elections.
watch the body count if they ever were to try something as stupid, insane, and illegal as coniscation.
(invest in your local mortuary! may as well make something good of all this dictatoral krapo!)
***they are “designed to kill large numbers of people quickly.” ***
Bunkum. Charles Whitman used a bolt action to kill most of the sixteen people in 1966.
Richard Speck did not use any guns to kill six student nurses in the same year.
Mark Essex used a Ruger Deerslayer 5 shot tube fed .44 magnum to kill nine people in New Orleans in 1973.
Ronald Gene Simmons strangled seven of his 16 victims, drowned one and shot the other half with a single action Ruger.22 pistol.
This is just another attempt to ban guns by any means. Throw a gun law against the wall and see if it sticks, then build on it to confiscate the rest.
Given the rate of boating accidents, it might be time to go shopping again.
