INDEPENDENCE, Mo. -- Prosecutors charged two men with first-degree statutory sodomy Monday.
They accused Thomas Luce, 46, and Juan Chester, 39, of sexually assaulting a 13-year-old boy during the weekend at Luce's Independence apartment.
Chester allegedly told police that he and Luce both were HIV positive and were taking HIV medication, according to a probable cause statement released by the Jackson County prosecutor's office.
The two could face additional charges if they tested positive for HIV, according to a fax from the prosecutor's office.
The boy apparently ran away from home and had been missing for several days when he called a friend from Luce's apartment. The friend wrote down the phone number from caller ID and gave it to the boy's mother, who called police, KCTV5's Amy Anderson reported.
Detectives said Chester admitted that he and Luce had sexual encounters with approximately 25 other juvenile males, and that they sometimes paid them, according to the probable cause statement.
When police arrived at the apartment during the weekend, they allegedly found the boy hiding in the bathtub. He told detectives the men threatened to hurt him if they told them what happened, according to police.
Luce and Chester were being held Monday in lieu of $250,000 bond each.

Jackson County prosecutors charged Thomas Luce, 46, of Independence with one count of statutory sodomy. Juan Chester, 39, of Kansas City faces two counts.
Based on statements made to police, authorities are testing the men for HIV. Police also are investigating whether there might be more victims.
Independence police said that about 12:30 a.m. Saturday, they found the 13-year-old boy inside Luce's apartment, 1109 S. Brookside Avenue. The boy's mother had reported him missing Thursday.
According to court documents:
The police found the Kansas City boy hiding in the bathtub. When officers asked the boy if he had been touched inappropriately, he answered, "I don't know. Will they go to jail if they did something to me?"
Police noticed the child acted "frightened and paranoid" and had hickies on both sides of his neck.
The boy told police that he was forced into anal and oral sex and forced to watch the men having sex. The boy told police that the men allegedly threatened him if he alerted anyone about the incident.
Independence police said the boy met the men at a Kansas City public library.
Luce is registered as a sex offender in Jackson County, police said.
