JUSTICE THOMAS, dissenting.

I join JUSTICE SCALIA’s dissenting opinion. I write separately to note that the law before the Court today "is . . . uncommonly silly." Griswold v. Connecticut, 381 U. S. 479, 527 (1965) (Stewart, J., dissenting). If I were a mem-ber of the Texas Legislature, I would vote to repeal it. Punishing someone for expressing his sexual preference through noncommercial consensual conduct with another adult does not appear to be a worthy way to expend valu-able law enforcement resources.

Today’s opinion is the product of a Court, which is the product of a law-profession culture, that has largely signed on to the so-called homosexual agenda, by which I mean the agenda promoted by some homosexual activists di-rected at eliminating the moral opprobrium that has traditionally attached to homosexual conduct. I noted in an earlier opinion the fact that the American Association of Law Schools (to which any reputable law school must seek to belong) excludes from membership any school that refuses to ban from its job-interview facilities a law firm (no matter how small) that does not wish to hire as a prospective partner a person who openly engages in homo-sexual conduct.

A majority of the SCOTUS, acting as a superlegislature of unelected, life-tenured lawmakers from overwhelminngly liberal backgrounds has decreed, "We prefer the progressive way the liberal California Assembly has dealt with this issue. As liberals, we find it most satsifying andf acceptable. Therefore we now pass a law requiring the other 49 state legislatures to do it like California has done it."

Everyone should take note that dissents are just as important as majority opinions. Dissents can form not only a warning but as the kernel of future majority opinions. This dissent can be used to limit this opinion solely to consentual sex in the privacy of the bedroom which had no (in theory) impact outside the bedroom.

If remains to be seen if those who are outraged today will be outraged in 2004, 2008. The homosexuals want your children and grandchildren, and the homosexuals are not going to give up until they have them.

And there you have it. "countless judicial decisions and legislative enactments" have relied upon the majority's belief.

What we have today is a Supreme Court that defies the majority belief and allows immorality.

Where before a society might well expect devine punishment if the majority embraced immorality. Today we are in a situation where the Government specifically the court has embraced immorality to an extent far greater than the people have.

The great question is whether the people will be able to assert their rights and turn back the court's decision or whether by the court's permissiveness, society will degrade to the point that the majority indeed deserve devine chastisement.

I love the logic that since all men and all women are prohibited from committing sexual intercourse, there is no equal protection issue.

I guess we could enact a law banning all Jewish religious ceremonies, and argue that the law is not unconstitutional because it equally bans gentiles and Muslims from performing Jewish religious ceremonies.

It's been an interesting week.

The Supremes came out in favor of sodomy, Jay Leno and Snoop Dog both endorsed the Terminator for Governor of California, and 95% of the Democrats in the House voted against while 90% of the Republicans voted for.....drugs.

Actually, the Court has said that government should stay out of the so-called "culture war", not letting either side using legal compulsion as a weapon. A suprisingly sloppy opinion from the future Chief Justice.

Isn't the real issue here morality? In our PC driven society diversity taken to its extreme trumps morality. That's what they've been warning us against PC all along. I'm not surprised so many have become addicted to the PC kool-aide.
