California: Court says "Pass budget or cut spending"

Sacramento -- An appeals court on Wednesday severely restricted the state's ability to spend money -- including financing for schools -- if the governor has not signed a new budget by the July 1 deadline.

The California Court of Appeal in Los Angeles also said state workers could be paid only the federal minimum wage if the Legislature and Gov. Gray Davis fail to come up with a budget when the new fiscal year begins.

But judges from the Court of Appeal said Connell had no authority to spend money without an authorized budget. They did say, however, that the state could continue funding federally mandated programs such as welfare and food stamps, and pay workers at the federal minimum wage -- $5.15 an hour.

I think the majority are still Republican appointees (albeit the Republicans who appointed them were the 'moderate' types, and so somewhat weak in the knees on many issues).

Yes, you are mistaken. Most of the current State Supreme Court members were appointed by Republican governors after voters got rid of the late Chief Justice Rose Bird and two of her colleagues in 1986. Understand, I not saying that the California Supreme Court is particularly good, just that it is not packed with liberal Democrats.

Power crisis. Campaign funding illegalities. Oracle contract debacles. Idiotic proposed laws drawing major fire from the constituents. Now this. Gray Davis and the Democrats must wake up each day now wondering what fresh hell awaits them. Couldn't happen to a nicer bunch of folks.

What will be interesting with this development is that it's going to give the Republicans a stronger hand when it comes to the budget. The state constitution requires a 2/3 vote to pass the budget, and there are just enough Republicans left to constitute a roadblock if they hang together. If they have the backbone to use this power, they might be able to wring some spending cuts out of the Democrats.
