When I was an INS agent we had arrangements with the local and state police where an agent could be reached 24/7 and respond in person unless it could be determined by phone that the person could be detained sight unseen.A situation like the one described could never had occured in the places I worked.New York is another story-they have plenty of good agents,but the supervision as I recall it in my infrequent(mercifully)contacts with that office was composed of useless turds.Many of the best agents in New York quit and went to US Customs.Those that could transferred out.
