It is not the nature of the organization that determines whether or not RICO applies, it is the acts of those individuals who control and run those organizations. Even judges and politicians have been convicted under RICO. Organizations do not commit crimes; individuals do, although an organization can be held liable for the damages of the RICO predicate acts.

Even Don King, who is legendary for this type of shenanigans, doesn't get the same pass from law enforcement that Jesse does.
