Interpretation of law allows confiscation

CUMBERLAND -- Under the current interpretation by the Maryland attorney general concerning the confiscation of firearms, citizens who had misdemeanor transgressions at any time in the past could have their guns taken, according to Delegate Kevin Kelly.
Such misdemeanors include cheating, defamation of private persons, unlawful assembly, blasphemy, profanity, common scolding, disturbance and disorderly conduct.
"As long as a person could have been sentenced to one year or more in jail, their guns can be confiscated," Kelly said.
"If you actually spent more than a year in jail then you did something bad and I don't want you to have a gun either. But like in Larry's (Dicken) case, two young bucks got into a shoving match and he has been law-abiding ever since then. He should be allowed to have his firearms."
Dicken said he didn't even use guns until after his son graduated from high school in 1998 and he found himself needing something to do.
"My brother hunted and I got into it that way and found that I enjoyed shooting and hunting," Dicken said.
Kelly said his fellow legislators tell similar stories involving their constituents elsewhere in Maryland. His request in October for state police to quantify such confiscations and explain the individual convictions upon which actions were based has gone unanswered.
He is sponsoring a bill that would prevent state officials from enforcing the federal statute that allows confiscation of the weapons. It also would prohibit anyone who was sentenced to a year or more in jail from owning or possessing a gun.
"I'm hopeful that the bill will pass and that I will be able to use the firearms again," Dicken said. "At first I was so upset that I brought in my American flag from out front. I felt like I didn't have any freedom anymore. Then Sept. 11 came and everybody everywhere was buying guns to protect themselves, but I wasn't allowed to protect myself. Now, I've got $5,000 worth of guns I can't use and I paid for a membership at the Fort Hill Rifle Club and I can't shoot. I hope it works out. I really want to go hunting next year."

I agree completely with this, but it isn't going to happen.
When Gage's men marched on Concord they were met by 5000 armed farmers. This in an area that didn't have a population of more than a few hundred thousand at most.
Several years ago Citizens for Safe Government - the local gun rights group organized a pro gun rally on a Saturday just before the General Assembly convened. We took out ads in the Marietta and Gwinnett papers (we refused to spend any money with the odious Atlanta paper), got it mentioned on several talk shows, and phone banked to call about 3000 people. We spent everything we could on advertising the event (about $2200)
When the day came we had Nancy Lord, and several other pretty well known speakers (and one not so well known speaker, yrs truly) We had a grand total of 143 people show up. This in an area where the population is easily 4 million. Out of 4 million people, 143 were concerned enough to give up their Saturday morning. We didn't ask anyone to lay their life on on the line as did the Mass colonists, but simply spend about 3 hours of their time. The turnout was really disheartening. So while I'm pretty sure that at least some of the JBTs who come to collect my guns will accompany me out of my domain in body bags, I don't hold out much hope for the US.
He was convicted of a misdemeanor 12 years ago but could still buy everything but a c.c. permit.Last year he bought a new 30-06 for deer season without a problem.The lady down at the GBI was not interested in helping. She misread the report as if he was a felon.
Let me ask everybody this; if he was buying a shotgun for the wrong reason, why would he buy an $800.00 dollar one instead of a $150.00 gun?

Somehow I doubt it. It wasn't that people didn't know about it, they just weren't interested. Of the 3000 or so who were called - a fair portion were in Douglas county. Mostly who showed up were the hard core volunteers - the ones who pass out leaflets at election time, the ones who stuff envelopes and the ones who work at gun shows collecting post cards.
But this is irrelevant. It is probably fair to say that 1 or 2 percent of the metro area population knew about the rally; this is 40,000 to 80,000 people. Of these only 143 were interested enough to bother to attend.
When the "brady" (may that evil woman, her husband, and all of the politicians who voted for that law rot in hell forever) passed, our right to keep and bear arms was ended by the government. If you have to ask permission of the government to do something it is not a right. It is a privilege. A privilege may be revoked at any time for any reason - or no reason at all.

I don't think the redcoats ran into 5,000 armed men at once in one place during the whole course of the time leading up to the war. Concord saw about 300 men resisting, IIRC. The point is that once resistance starts, it will spread, sure as you're sitting in Georgia. Your 5,000 figure is the ratio to which we outnumber LE's, about 5,000 to one. Get with your neighbors and make an agreement to resist. No sense in going into a body bag if you don't have to. How well do you think your small number who turned out would do against a similar number of JBT's? I think they would kick a little hindend myself.

Will it? Resistance started several times - Waco and Ruby Ridge could be considered the start of resistance. There are plenty of people who post on this forum who hold Koresh rather than the Federal Waffen SS responsible.

I suppose that against an equal number of JBT/LEO's the leos would not survive, if only because they are at their hearts mostly cowards. They do real well in 40 to 1 situations, but in reality, that is how it's most likely to procede (unless some evil old fart manages to ambush them with - whoops, I can't tell you this part)
What has given me a pessimistic view is spending lots of time and money to try and turn back the tide, only to see the steady spread of statism and the concomitant loss of rights.
What is really depressing is that there are so very many morons who really think that this endless loss of individual rights and their ursurpation by government powers is to their benefit. The deluded fools think that the government is there to help them.
Some guy named Buchanan got a nobel prize in economics in 1986 for public choice theory - which basically is the notion that government is just as self serving as any other entity. Perhaps even more so because it has annointed itself with the sole right to use force to coerce its victims to do its bidding.
Unfortunately, the vast majority of Americans somehow think that what is immoral - robbery and murder for example - between individuals is justified when it is committed by a group of self-appointed individuals who call themselves government. The government JBTs who enforce the will of the few on the many not only use force, but then cloak themselves in moral superiority as if they were right to do so. The depressing thing is that the majority of idiots in this country agree. Morality, right and wrong are not determined by majority vote or by who is doing an action. I just wish more people understood this.
