Circumventing Senate opposition, President Bush signs recess appointments for Otto Reich and Eugene Scalia, The Associated Press has learned.

..I saw several mentions of 'opposition' to appointments... but it mentioned the individual GOP Senators by name, rather than generalizing to the whole body

Ahhhh.... I assume that the individual GOP Senators named were portrayed as 'obstructionists' and Clinton needed to get his 'team' assembled whereinas President Bush is presented as CIRCUMVENTING senate (pssst... Daschle) opposition. The GOP Senators did hold committee hearings wherein the Daschle-led Senate will not even conduct hearings nor schedule a vote in the Senate Chamber.

WASHINGTON (AP) - Circumventing Senate opposition, President Bush (news - web sites) signed recess appointments Friday for conservatives Otto Reich and Eugene Scalia.

A senior administration official, speaking on condition of anonymity, said the White House gave Congress formal notification of the long-threatened appointments early Friday afternoon.

By exercising his executive authority while Congress is in recess, Reich and Scalia will be allowed to serve until Congress recesses again at the end of the year.

The kind of story we never saw during Slick's term...

I was referring to Judges.

Interesting distinction, but the Constitutional provision for recess appointments applies to "vacancies" and does not exclude judges; it only specifies that the commission to which they are appointed expires at the end of the next session. In theory, he could make the appointment and if the senate refuses then to act on the appointment during the next session the commission would expire creating a vacancy once again which could be filled with a recess appointment. Therefore, he could probably appoint the judges with recess appointments and force the senate to act on the appointments this way. They would reject some, but probably many (perhaps most) would be confirmed in order to give the impression they aren't completely partisan and obstructionist.

Sadly, there was a gap in my civics education. That gap has been filled by legal scholars on cable news (FOX, can't stand CNN) and FreeRepublic.

The democrat leadership in the senate refused to allow a vote on numerous GWB appointments during this session. The recess appointment was the appropriate response.

Bill Lann Lee did not have a recess appointment. Instead, he was made 'Acting Assistant Attorney General' of the Civil Rights Division and Counselor to the Attorney General for civil rights enforcement at the Department of Justice. 'Acting' status only lasts 120, but it can be renewed indefinitely.

A senior administration official, speaking on condition of anonymity, said the President gave Congress the upraised middle finger with one hand while clutching his crotch with the other and shouting "I've got your Senate rejection right here!" early Friday afternoon.

By exceeding his executive authority while Congress is in recess, clinton will allow Lee to serve until Congress recesses again at the end of the year, when he will once again use the recess appointment to install him to the post.

Funny how that works, huh?
