Police official says Ohio ban can help prevent crime

CINCINNATI -- Ohio's law against carrying concealed weapons can help police prevent crime, an assistant city police chief testified Monday in a lawsuit challenging the state ban.
The law allows an officer to arrest a person if a concealed weapon is found.
"It is a tool for law enforcement," assistant Chief Richard Janke said. "People often have motives, or other reasons, for carrying concealed weapon. They might be planning to use the weapon during commission of another crime."
Several workers, including a private investigator and a pizza delivery businessman, are asking Hamilton County Common Pleas Judge Robert Ruehlman to declare the ban unconstitutional. They say the law violates the Ohio Constitution because it requires those arrested to prove themselves innocent by demonstrating they have a legitimate reason for carrying a concealed weapon.
Ohio law allows only law enforcement officials or officers of the state and federal government to carry concealed weapons.
Lawyers for the governments said the right to bear arms does not prevent the state from regulating how citizens may carry guns. They said concealed weapons pose a threat to police officers and others.
The plaintiffs include the Second Amendment Foundation of Bellevue, Wash., which is paying for the lawsuit, and Ohioans for Concealed Carry.
The Brady Center to Prevent Gun Violence, a Washington-based organization that supports gun control, is helping argue the city's position.
Janke also testified that a police officer, before making an arrest, could check with a prosecutor to see if a person had a valid reason to be carrying a concealed weapon.
Ruehlman, who was a prosecutor for 10 years, then began questioning the witness, saying he could not recall ever getting such a question from an officer.
"I've not had a case where all this discretion and discussion took place ... This is the first time I've ever heard of this. The cases I've had, the person is locked up and charged and has to defend himself," the judge said.

And while we're at it, why not allow the police to arrest you if you're carrying cash. After all, you might be dealing drugs. Oh, never mind, we'll just let the police "seize" it without an arrest.

I am opposed in principle against laws as "tools for law enforcement". Why not just make it against the law to breath, then law enforcement can arrest anyone they think should be. This argument is saying that there is no need for legislatures or courts. Just let the police decide everything!!
