Berry recounted how President Reagan fired her in 1983 and how she fought through the courts to get back on the board.

Anyone remember this in detail? I think it rings a bell for me, but that's about it.

This kind of crap needs to be met strongly. Seat the legally appointed commissioner, with US Marshalls if necessary, and escort out the one who is not entitled to the seat. Let the usurper sue, unsuccessfully, for the seat. I guess it's an attempt to muzzle people whenever we have an election and a new President appoints the people he wants to run the country. What a bunch of crap.

Mary Frances Berry's decided to play hardball. She's declared war on the White House and signalled her determination to do anything and everything to retain the liberal majority on the commission. The rule of law be damned. Preserving the independence of the commission my butt. She's afraid for her own and fellow Rats power. Its going to be interesting to see what the courts say about her raw naked power play.

The odds are high that this case will go first of all to a Clinton appointee on the U.S. District Court for the District of Columbia, who will very probably rule in Berry's favor, however bad the arguments may be for that result. I suspect Berry would not be doing this if she had not gotten assurances from the Dems that they will back her.

Berry argued the documents are wrong and are trumped by federal law, which says new commissioners will fill a six-year term. Democratic Reps. John Conyers of Michigan and Jerrold Nadler of New York wrote Berry on Thursday to say the law as amended in 1994 reflects her interpretation.

Does anyone know which section and title of the US code that Conyers and Berry are referring to?

By the way, this article appeared on page A39 (but the first page of the "Federal Page"). The Washington Times reported on this on the front page above the fold.

Obviously, the liberal wing of the dems is looking to manufacture an issue, create a scene. Jesse and rev Al will be along shortly, in time for the news bites, and the Black Caucus will all join in. However, it won't play well in the rest of the country, especially in the more consrvative dem districts...This is another sign of the Dem leadership being out of touch with a portion of its constituency, same as with the Ashcroft hearings yesterday... Look for the GOP to retake the Senate and pick up 10+ seats in the House, and then hopefully, dump Lott and start to play hardball..

During the meeting Berry voted to extend the certification of the election, allowing the handcounts of the four counties cherry picked by the Gore team to be included.
