DOJ snatches another teen under Patriot Act!
WRAL ^ | 08/14/2009 | Sugarpuddin88

The US Patriot Act was used AGAIN to incarcerate the juvenile & model citizen for months without being charged with a crime! Arrested March 5 not indicted until July 9 10th

He is detained on the basis of "good faith" beliefs on the part of the investigators, as permitted under the Patriot Act, rather than the normal legal standard of "probable cause" to suspect his commission of a crime.

Fact: Ashton has an airtight alibi for the night he supposedly made a threat against Purdue University in Indiana; while the real perps go free to brag about hacking his skype online!

16-year-old told the judge he needs dental work and education that he can only get outside the youth detention center where he has been since March But they STILL refuse to let him out!

Questions: Why was he held in Indiana rather than NC where the alleged crimes occurred?

Why does the DOJ not come clean when asked questions; and why is he held without charges for months, against human rights & any sense of moral decency as outlined in the US Constitution? Why does the DOJ get away with incarceration at all due to Ashtons alibi?

The real teen pranksters who did it broadcast their activities on a web site called fridaynightcranks(dot)com which is sponsored by SpoofCard (marketing byline: Be who you want to be), featuring such services as Fake a caller ID: Have any number appear on the display etc

As of August 6, the DOJ wont say whether the actual charges will include provisions under the Patriot Act. None the less, the teen’s original arrest & incarceration without charges & habeas corpus are only permissible under the US Patriot Act. This is in violation to basic human rights & decency under the US Constitution!

We have no rights under the Patriot Act to even defend them, because the Patriot Act basically supersedes the Constitution," she said. "It wasn't intended to drag your barely 16-year-old, 120-pound son out in the middle of the night on a charge that we can't even defend

Interviewed by WRAL-TV, attorney and former candidate for North Carolina Attorney General Dan Boyce notes:

"They're saying that 'We feel this individual is a terrorist or an enemy combatant against the United States, and we're going to suspend all of those due process rights because this person is an enemy of the United States"There's nothing a matter of public record All those normal rights are just suspended in the air."

The FBI blatantly lied to the federal magistrate, Judge Gates, that you could not hack an I.P. address they wanted my son, and they wanted to make an example of him.

this is a 16 year old American. I would bet the farm that he is not a muslim or a black. If so, they would never have picked him up, much less kept him locked up! We white conservatives do not offer the same help to one another as the 2 other groups do.

Soooo, this is what the patriot act is going to be used for, huh? Funny thing, I thought it was FOR patriot, not TO ROUND UP patriots!

Time to cancel the Patriot Act. What a crock.

Does he have Asperger’s Syndrome? If not, say he does. Also, it would help with the media if he said something about Dick Cheney making him do it. That’ll get him more sympathy than saying he didn’t do it at all.

By the way, are you being paid for this post or are you a family member?

When most everyone praised The Patriot Act when passed some of us warned it could be misused.

Oh, this is the jackass that phoned in bomb threats for fun and profit. I had to do a bit of searching since the post only references the pitiful injustices that ‘Ashton’ has to bear.

Enjoy Prison, Ashton.

Teen Ashton Lundeby Charged as an Adult for Bomb Threats

http://www.wired.com/threatlevel/2009/07/lundeby-indictment/

Ashton Lundeby allegedly staged bomb hoaxes from mid-2008 until his arrest last March. He’s charged with conspiring to make threats against Purdue, the University of North Carolina, Florida State University, Clemson University, Boston College and FBI offices in Colorado and Louisiana.

...

Lundeby’s mother, Annette Lundeby, admitted in an interview with Threat Level in May that her son was “Tyrone” — a notorious prank phone caller who performed for a live internet audience in exchange for PayPal donations. But she claimed that he was with her in church at the time of the Purdue hoax.

An former fan of “Tyrone” who helped police track him down told Threat Level that the prank caller had begun accepting donations in exchange for shutting down donors’ schools for a day with fake bomb threats — a charge reflected in the indictment.

“Ashton Lundeby’s arrest stoked widespread outrage on the web after Raleigh, North Carolina’s WRAL-5 reported on the case, noting that the boy is a patriotic homeschooled student with an American flag bedspread. Much of the online fury was triggered by Annette Lundeby’s incorrect claim — uncritically reported by the station — that the boy was being held without any legal rights on the authority of the 2001 USA Patriot Act.”

You may want to look at the threads from around the time Ashton was first arrested.

This kid is from my county. I know people at his church and as for homeschool, not that long. He had been enrolled at a private school and had not been homeschooling for very long.

He pretended to be black and made prank calls for payment using paypal.

I smell nonsense.

Nothing about this case looks to have anything to do with the patriot act at all.

“He pretended to be black and made prank calls for payment using paypal.”

Humorous, maybe. Annoying, maybe but not criminal. However, I’m pretty sure they’re charging him with making multiple bomb threats against the FBI and some universities and not for pretending to be black. I could be more charitable towards him if it was a one time deal. Unfortunately, he seems to have made a little criminal enterprise out of it.

For background on this story, one of the early articles claimed it was all a hoax.

He is detained on the basis of "good faith" beliefs on the part of the investigators, as permitted under the Patriot Act, rather than the normal legal standard of "probable cause" to suspect his commission of a crime.
