While pro-abortion "Catholic" politicians are without any doubt guilty of mortal sin, and thus not really in union with the Church, the vast majority of canon lawyers appear to hold that in order to incur the AUTOMATIC excomunication for abortion, the participation in the abortion must be close and direct. When it comes to Kennedy, for instance, one would have difficulty that such-and-such a vote in the Senate caused THIS particular abortion.

But the bishops should have excommunicated the lot of them 30 years ago. Let THEM take the case to Rome. Let THEM take the risk of having the issue dragged out over the front pages for months on end.

Most of those who were bishops in the U.S. 30 years ago are probably in Hell. A frightening thought, but there is little evidence against it.
