Hopefully, the U.S. SCOTUS will eventually reaffirm that religious liberty is not directly mandated for religious institutions, but is most directly mandated for the individual and the free associations we build with other individuals, whether or not those associations are formalized as a religious institution. The religious liberty mandated in favor of the inidividual is likewise mandated for Yeshiva University, without Yeshiva being held as an adjunt of a religious denonomation/institution.
The following are the component parts at the heart of the matter.
1. Religious liberty (freedom of religion) is mandated by the U.S. Constitution.
2. Religion is a belief system noted by a statement or statements of beliefs held by that system.
3. A religious beleif system is what religious liberty protects. It protects not just the individual but the free associations formed by individuals as well, no matter how organized.
4. Being formally organized as a religious institution is not essential for an individual or organization to have and operate by a core set of religious beliefs; beliefs protected by the U.S. Constitution’s mandated right of freedom of religion.
