This particular “States Rights” issue died with the 14th Amendment. The Free Exercise Clause has been within the domain of the Federal Judiciary to interpret regardless of whether government violates it at the local, state, or federal level.
I mean, hell, they determined that no state has the “right” to deny same-sex marriage...and that’s not even close to being explicitly protected by the Bill of Rights.
