Jesus DIRECTED Nicodemus to focus upon the spiritual birth done by god Alone by faith alone in Christ alone, and therefore beyond just being born from the water world into the air world. Baptism has zero to do with God Justifying a person to Himself.

ONLY God can Justify someone to Himself and there are no works by you or me that count in that because even if we thought we were doing works of righteousness, without actual righteousness in us by His imputing Christ's righteousness to us, we are not capable of doing any works of actual righteousness.
