Obviously, it's not there. The real answer to this case is "0bamacare is unconstitutional".

These legal conundrums as you aptly call out are the result of the myriad of differences in human creations. It is not unusual for so many differences to cause the need for joint considerations. The Founding Fathers were very astute as to this in both the Declaration of Independence and the USA Constitution. The dilemma in all this is that the Founding Fathers could not formulate a Constitution based on unforeseeable situations. Obama and his political renegades with the help of the ‘don’t care’ and ‘what difference does it make? crowd were quick to capitalize on such intentions.
