Think of the days when our Founding Fathers were living.

What they envisioned is the individual states deciding such things. If a state enacted oppressive laws, it's people could work to change the laws or move to a state more to their liking.

I would much rather that than what we have now, but I also believe that there are some freedoms that are beyond even the control of state’s rights. Some are mentioned in the Constitution, but others are not.
