God ordained the death penalty for rape. No, the Bible ordained the death penalty for two people having sex outside of marriage. If the girl could prove she wasn't willing, she might (might) escape the penalty, but his penalty was the same whether she consented or not, which means that her consent is meaningless in terms of his guilt.

However, not all sex outside marriage warranted the death penalty.
