The State had the primary responsibility to prosecute but did not . Why? Was it lack of empirical evidence? Until you can show dis positively that you are in command of the facts, e.g. state criminal investigative reports ,which you can’t, you would be well advised to remain silent on this issue based on your ignorance of all factual material.
