In the ten commandments "kill" has always been understood as "murder", at least it always should be.

The actual commandment says Thou shall not commit murderAgreed. I think the problem arose in the 1600s King James translation, when in those times, "kill" meant murder and "slay" meant kill (as in combat). It's a convenient mis-translation for the anti-death penalty types or those seeking to dodge the draft.
