I don’t agree with that statement, though we’re getting into academics of the supralapsarian/infralapsarian stripe at this point. A judge can choose to show mercy to one lawbreaker and not another and not be culpable in the second one’s just punishment - particularly when that one does not wish to be shown mercy and disdains the judge.
