Time for a counterclaim for malicious litigation, based on Rule 11 if they're in federal court, or whatever the California equivalent is of Georgia Code 9-15-14 . . .

If they've lost this same claim six times before, this amounts to harassment and malicious litigation. They ought to be able to hit the Bish up at least for attorney fees and litigation expenses.

. . . at least around here, it's the courthouse thermonuclear device and you only use it in the most extreme circumstances. BUT a six-time losing argument is pretty extreme!
