This situation is different, as Michael and Terri's marriage has been dissolved through her death. Michael is a widower and can marry again according to the Church. The issue is, can he specifically marry Jody in light of the fact that it can be construed that he killed Terri in order to marry Jody.
He is certainly free to marry anyone else.
The issue for a canon lawyer is, I think, as follows. The state does not consider Terri's death a crime. I am of the opinion that Michael did commit a crime, or a series of crimes, that resulted in her death, whatever the legal term is for the method he employed. Many in the Church are of the same opinion. But -- here's the rub -- is the Church prepared to formally and canonically view Michael's actions as a crime even though the secular courts do not?
Given that the secular law allows abortion on demand, how much is the Church bound to respect it?
The legal term is "allowing her to die, as per her wishes".
My understanding is the Church is against euthanisia. So lets for a second set aside the fact that he purposefully murdered Terri...although in criminial law Shivo didn't do anything wrong, in church law to aid euthanising someone would to me make it killing in the eyes of the church and therefore the church should NOT have allowed the second marrigage.
On a side not its proposterous that the church will allow this but won't allow people to get married a second time in events such as abuse, neglect and such or make non catholics do this annulment dance if they just so happen to marry a catholic. But the allow this monster to go on with his wife.
This beast denied Terri Communion in her last days. That speaks volumes, but I"m sure God will handle this in the end ;)
