Claremore, Okla.Erroneous; arbitrary; capricious. Using these three words to describe Rogers State University's case against Joshua Fellman, Oklahoma District Court Judge Dwayne J. Steidley ruled in a court decision filed March 8, 2004, that RSU administrators were indeed unjustified in expelling Joshua Fellman.

An original article, by Jeremy Reynalds, about this case was published on the Talon News site December 1, 2003.
This student was expelled from RSU on what appear to be trumped up charges. He was outspoken against the administrations treatment of a fellow student (Bickford) who was fired from a student job for signing "God Bless" to his e-mails. Some months after Bickford's firing, Fellman, Bickford and Fellman's sister (a minor) were pulled from class, held by armed guards, interrogated, denied repeated requests to call parents, and subsequently expelled. Numerous attempts to obtain facts/evidence to support the charges were to no avail. The tapes of the hearings were altered, the expulsion letter was pre-dated, the student code book was altered to allow the president to put 2 of his own staff on the hearing board, etc. The judge found on all counts that RSU had violated Fellman's constitutional right to due process, violated their own student code, and violated the administrative code of Oklahoma.
You can read the whole story (sorry, it's really too long and complex to post here) at www.rsusaga.com. You can also read Judge Steidley's Final Court Order at the same site.

I was gonna say it sounds like he needs to sue the hell out of the University, its responsible faculty and staff, the State, and both of the Police Departments.
I'm not litigious by nature, but these people need to be punished for them to stop their abuses. Waving a piece of paper saying "the judge says I'm right" is not going to make these people change their ways.

It appears that Fellman will be taking the case further. Attorney Kumpe made a statement to Randy Ellis of the Daily Oklahoman that he intends to file a federal suit in the next few days (you can go to NewsOK.com to read the article titled: Judge Reinstates Student).

What financial compensation is Fellman and his fired advisor getting for this injustice?
If the fascist institution is not made to pay big, fascists don't stop their activity. If Rogers only has to reinstate the kid they hate, without big financial consequences, they won in their effort to injure and punish a Christian kid even if the kid gets re-instated by a judge.
This is a big question. I hope the young man sues the University into the middle of next week. They wont stop until they hurt.
