The only reason I say this shouldn't be buried is because as the malpractice trial, Schiavo presented the "loving and caring husband" act. If he shows that even before her "collapse" that he was anything but, then they have something.
Where someone is appointed a guardian, spouse or not, that person's character and past behavior in regards to the person he is supposed to be "guarding" is very much relevant, especially when their is a history of deception.
