Actually, this sounds like drugs claim another victim. He didn't avoid treatment out of fear of consequences. He sought treatment out twice before.
I am not saying that he should be treated as a criminal though, nor that he should get off scott free. What I am saying is that its a bloody tough issue, and the radicals on both sides of the WOD issue are out to lunch.

Drug addiction ruins lives, and more people don't seek treatment because they fear the consequences of admitting to illegal acts.Until they hit bottom, they prefer to live with the addiction, providing they don't croak first. The legal niceties don't really enter into it unless they're arrested.

Clinton can commit adultery in the Oval Office, commit perjury, and it doesn't matter.
Rush admits to addiction and will face the consequences of this admission, let alone the pain of detoxification... and then be skewered for it.

Rush has my deepest heartfelt prayers for a full recovery and finding a way to live with the pain.
I am deeply saddened for him and only hope he is treated at least with as much dignity as others with similar problems have been treated.

Rush asked for prayers, no problem, I can do that.
For helping the cause of creating a stronger nation, he deserves our good wishes. Me, it's the LEAST I can do for a great American. I owe him plenty. Perhaps my very sanity.
Rush put to rest the lie that Republicans are hateful, angry zealots with no sense of humor.
