It is my understanding that the insanity plea is designed for people who do not realize what they did was wrong. For example, if Malvo thought he was living a video game, or playing Dungeons and Dragons while he killed people, this would be a valid defence. IMHO, this defense will not work, for the following reasons.

He stalked his prey, and then left by stealth. This indicates the capibility to reason how to commit a crime (planning) and to elude authorites afterwards. The car in which he travelled was specifically modified to work as a sniper's haven. Thus, he realized that what he was doing was wrong, he worked to design a method of execution, he planned the commission of the crime, and then followed through

Secondly, he left notes with messages for police to find. He realized he was being hunted for breaking the law, and promised to continue doing so. Hence, he was fully aware of his actions, the suffering of his victims and he revelled in it. He's a dead man, he just doesn't know it yet.
